County Engineer Lyle Tabata Deputy County Engineer Subject: SHORELEQESE'fBACKAPPLICATION SUBSTANTIAL IMPROVEMENT DETERMINATION KDHI`O SHORES —BUILDING PERMIT APPLICATION NO, 15-1876 TMK: (4) 2-8-005: 014 Dear Mr. Schurch; The Kauai County Shoreline Setback and Coastal Protection Ordinance (Ordinance No. 979) Section 8-27.2 defines substantial improvement as "any cumulative series of repairs, reconstruction, improvements, or additions to a structure over a ten (10) year period, where the cumulative cost equals or exceeds fifty percent (50%) of the market value of the structure before the start of construction of the first improvement during that ten (10) year period. For the purposes of this definition, substantial improvement is considered to occur when the first alteration of any wall, ceiling, floor, or other structural part of the building commences, whether or not that alteration affects the external dimensions of the structure." The Department of Public Works (DPW) Engineering Division has reviewed the proposed improvements for Unit 405 at the Knhi`o shores condominium. The structure contains 75 units. DPW has determined that the proposed improvements do not constitute a substantial improvement. A summary of the calculations follows. 1V,Carliet l�alue There were 14 total building permits for the structure within the past 10 years. The frst permit, BP No. 06-2006, was approved in 2006. Therefore, the market value used in the calculations is the Replacement Cost New Less Depreciation (RCNLD) value in 2006 for the structure. The 2006 RCNLD was determined to be $7,346,900. The Engineering Division has used the RCNLD as determined by the County's Real Property Assessment Division in its calculations. If the owner chooses to dispute this value, then an appraisal of the structure must be provided at the owner's expense. Work involves performing interior renovations i.e. cabinetry, countertops, tile floor covering, doors, and painting (See attached Exhibit "A", 8-1/2" x 11" blueprints). In order to obtain a waiver from the provision of a certified shoreline certification, the Kauai Planning Department's application for a Shoreline Setback Determination requires a letter from the Public Works Department stating that the proposed interior renovation work does not constitute a "substantial improvement" of the structure.
