RESOLUTION ESTABLISHING NO-PARKING AND TOW AWAY ZONES
ALONG A PORTION OF HEHI ROAD AND AT THE ENTRANCE TO
HANAMA’ULU BEACH PARK,LIHU’E DISTRICT,COUNTY OF KAUA’I
WHEREAS,Chapter 16,Article 2,Kaua’i County Code 1987,as amended,
authorizes the County Council to create,define,re-define,eliminate,or change all
no-parking zones;and
WHEREAS,Chapter 16,Article 9,Section 12,Kaua’i County Code 1987,as
amended,authorizes the County Council to establish tow away zones;and
WHEREAS,Hehi Road and Hanamã’ulu Beach Park are located in the LIhu’e
District,County of Kaua’i,State of Hawai’i;and
WHEREAS,the Engineering Division of the Department of Public Works,
based on an engineering and traffic investigation,has recommended that a
no-parking and tow away restriction be established along a portion of Hehi Road and
at Hanamã’ulu Beach Park;now,therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF KAUA’I,STATE OF
HAWAI’I,THAT:
SECTION 1.No-parking and tow away zones where parking is
prohibited shall coincide with the closure of Hanamã’ulu Beach Park and are hereby
established along both sides of Hehi Road and at the entrance of Hanamã’ulu Beach
Park,from a point 1,600 feet east of the centerline of Hanamã’ulu Road to a
point 2,375 feet east of Hanamã’ulu Road,as shown on Exhibit “A,”which is attached
hereto and incorporated herein by reference.
SECTION 2.The County Engineer or his representative shall post
appropriate signs designating the no-parking and tow away zones that are
established herein in accordance with the provisions provided by law.
SECTION 3.Any person convicted of violating said no-parking zone
restrictions shall be subject to the penalties prescribed in Section 16-21.6 of the
Kaua’i County Code 1987,as amended.In addition to the “No Parking”penalties
imposed on the motorists,all vehicles found in violation of the “No Parking”sections
above may be towed away and stored subject to the penalties prescribed in
Section 16-9.12,Kaua’i County Code 1987,as amended.
SECTION 4.Any person convicted of violating said parking restrictions
shall be subject to the penalties prescribed in Section 16-21.6,Kaua’i County
Code 1987,as amended.
SECTION 5.This Resolution shall take effect upon its approval and the
posting of the appropriate signs and/or markings.
