The subject lot of record contributes to the open space and scenic view planes of the surrounding Hanalei area. d. The subject lot could provide for additional outdoor recreational and educational opportunities for the surrounding North Kauai community. e. The subject lot of record has been offered to the County for sale by the owners of the lot for the price of $5,600,000.00 as part of an agreement to settle longstanding disputes regarding the use of said lot of record including the dismissal of several court cases filed against the County in both State and Federal court. f. L If further research demonstrates that the cost and process of acquisition and/or the establishment of a conservation easement is commensurate to the public interest served, the Department will be issuing a final review and evaluation at least 90 days prior to the first Commission meeting in April 2018. 2. If further research demonstrates that the cost and process of acquisition and/or the establishment of a conservation easement is not commensurate to the public interest served, the Department will notify the Commission of its findings and recommend the Commission decline further review of the subject property for acquisition. The Commission is further advised that this report does not represent the Planning Department's final recommendation in view of the forthcoming public hearing process whereby the entire record should be considered prior to decision making.
