EXECUTIVE SESSION: The Commission may go into executive session on an agenda
item for one of the permitted purposes listed in Section 92-5(a) Hawaii Revised Statutes
("HRS"), without noticing the executive session on the agenda where the executive session
was not anticipated in advance. HRS Section 92-7(a). The executive session may only be
held, however, upon an affirmative vote of two-thirds of the members present, which must
also be the majority of the members to which the board is entitled. HRS Section 92-4. The
reason for holding the executive session shall be publicly announced.

N. EXECUTIVE SESSION: Pursuant to Hawaii Revised Statutes (HRS) §92-7(a),
the Council may, when deemed necessary, hold an Executive Session on any agenda

1. ES-943 Pursuant to Hawaii Revised Statutes (HRS) Sections 92-4, 92-5(a)(4),

filed by GEICO Insurance as subrogee for Amanda Mixon, and related

SECTION 1. Findings and purpose. The purpose of this Ordinance is to
appropriate funds for the acquisition of a coastal property in Hanalei, Kaua`i,.
Hawaii, further identified as Tax Map Key (TMK) No. (4) 5-5-001:002 (por.) (being a
portion of Lot 127 of Land Court Application as shown on Map 26), as was approved
and authorized by the Planning Commission of the County of Kauai in Subdivision
Application No. 5-87-20 (the "Subdivision"), and recertified by said Commission on
October 14, 2014; currently identified as Lot 155 on a map that the parties intend to
submit to the Land Court being approximately 3.020 acres (See Attached Map). The
Council finds the following:
a. The subject lot of record is adjacent to the existing expanded
County Black Pot Beach Park and the Hanalei River.
b. There is a demonstrable need to preserve coastal beaches and
river areas in the county.
C. The subject lot of record contributes to the open space and scenic
view planes of the surrounding Hanalei area.
d. The subject lot could provide for additional outdoor recreational
and educational opportunities for the surrounding North Kauai community.
e. The subject lot of record has been offered to the County for sale by
the owners of the lot for the price of $5,600,000.00 as part of an agreement to
settle longstanding disputes regarding the use of said lot of record including
the dismissal of several court cases filed against the County in both State and
Federal court.
f. The cost and process for acquiring the subject lot of record is
commensurate to the public interest served.

SECTION 2. That pursuant to Sections 19.07B, 19.10A, and 19.15C (5) of
the Charter of the County of Kauai, as amended, Ordinance No. B-2017-821, as
amended, relating to the Operating Budget of the County of Kauai, State of Hawaii,
for the Fiscal Year July 1, 2017 through June 30, 2018, be hereby amended as
follows:

H. PROJECT DESCRIPTION AND USE
The subject lot of record is a 1.15 acre parcel located in Kalihiwai, Kalihiwai Ahupua`a,
Halalea Moku, Kauai Island, Hawaii. It is located within the State's Land Use
Conservation District, and its General Plan Designation is Open.
The lot of record is bordered to the south by Kalihiwai Road, it is bordered to the west by
Kalihiwai Stream and east by undeveloped vacant properties; it is bordered to the north by
the shoreline.

Based on the foregoing evaluation and conclusion it is hereby recommended that the
subject property receive PRELIMINARY APPROVAL for acquisition and/or the
establishment of a conservation easement.
If granted preliminary approval, the Department will initiate further research to determine
the specific cost and process for acquisition and/or the establishment of a conservation
easement.
L If further research demonstrates that the cost and process of acquisition and/or the
establishment of a conservation easement is commensurate to the public interest
served, the Department will be issuing a final review and evaluation at least 90 days
prior to the first Commission meeting in April 2018.
2. If further research demonstrates that the cost and process of acquisition and/or the
establishment of a conservation easement is not commensurate to the public interest
served, the Department will notify the Commission of its findings and recommend the
Commission decline further review of the subject property for acquisition.
The Commission is further advised that this report does not represent the Planning
Department's final recommendation in view of the forthcoming public hearing process
whereby the entire record should be considered prior to decision making. The entire record
includes but is not be limited to:
a. Pending government agency comments;
b. Testimony from the general public and interested others; and.
c. The land owner's response to an inquiry for acquisition.

H. PROJECT DESCRIPTION AND USE
The subject lot of record is an 1 acre parcel located in Kalihiwai, Kalihiwai Ahupua`a,
Halalea Molcu, Kauai Island, Hawaii. It is located within the State's Land Use
Conservation District, and its General Plan Designation is Open.
The lot of record is bordered to the south by Kalihiwai Road, it is bordered to the west by
Kalihiwai Stream and east by undeveloped vacant properties; it is bordered to the north by
the shoreline.
Nearly level, the lot of record is approximately (10) feet above sea level. An approximate 1
acre portion of the subject lot of record is covered with pine trees covering most of its

If granted preliminary approval, the Department will initiate further research to determine
the specific cost and process for acquisition and/or the establishment of a conservation
easement.
1. If further research demonstrates that the cost and process of acquisition and/or the
establishment of a conservation easement is commensurate to the public interest
served, the Department will be issuing a final review and evaluation at least 90 days
prior to the first Commission meeting in April 2018.
2. If further research demonstrates that the cost and process of acquisition and/or the
establishment of a conservation easement is not commensurate to the public interest
served, the Department will notify the Commission of its findings and recommend the
Commission decline further review of the subject property for acquisition.
The Commission is further advised that this report does not represent the Planning
Department's final recommendation in view of the forthcoming public hearing process
whereby the entire record should be considered prior to decision making. The entire record
includes but is not be limited to:
a. Pending government agency comments;
b. Testimony from the general public and interested others; and
c. The land owner's response to an inquiry for acquisition.
