Excused Vice Chair Theodore Blake, Commissioner Jett Jasper, Commissioner Herman Texeira and Deputy County Attorney Jodi Higuchi- Sayegusa Absent SUBJECT DISCUSSION ACTION Call To Order Chair Kimura called the meeting to order at 1:09 p.m. Roll Call The meeting commenced with a roll call of the Commissioners. Five Commissioners were present, which constituted a quorum. Approval of Deputy Planning Director Ka`aina Hull asked for the following amendments to the agenda: Ms. Kanna moved to approve Agenda H.2.a. change "Supplemental report No. 3 pertaining to this matter" to "Letter to the agenda, as amended. Ms. Administration pertaining to this matter" and I. La. change "Supplemental report No. 2 Ono seconded the motion. pertaining to this matter" to "Report from the County Attorney pertaining to this matter." Motion carried 5:0. Minutes of the D.1. Meeting of October 11, 2018 Ms. Ono moved to approve the Meeting(s) of October 11, 2018, minutes as the Open Space circulated. Ms. Kanna Commission seconded the motion. Motion carried 5:0. Communication There were no communications. (For Action) None Unfinished 11.1. Review and discussion of a 1.15 acre parcel located in Kalihiwai, Kalihiwai Ahupuaa, Halalea Moku, further identified as Tax Map Key (TMK) (4)5-3-003:068. (Preliminaryreport Business (For 4/12/18; Supplemental report No. 1 received 8/09/18; Supplemental report No. 2 received Action) 10/11/18 a. Supplemental report No. 3 pertaining to this matter. Ms. Sadora reminded the Commission that at the last meeting they requested to seek assistance from the Administration or Department to communicate with the landowner about their interest to purchase the Kalihiwai parcel. She said the Department was able to contact the corporate office on Oahu and the Princeville office on Kauai. Ms. Sadora read portions of Supplemental Report No. 3 for the record. (Document on file) Chair Kimura asked to be included in the Department's communication and negotiation process. She said two of the neighboring land owners contacted her stating they had on -going issues with the Parks & Recreation Department regarding camping and upkeep of the portable toilettes. Mr. Hull said the landowner reached out to the Department and expressed interest in selling and volunteered to complete an appraisal. He said for the record the Commission was not in negotiations; they are in discussions with what could become a potential acquisition and reminded them that the County Council had the authority to negotiate and acquire. Mr. Ms. Ono moved for an open - Hull asked for an open-ended deferral so that once they receive updated information from the ended deferral for Tax Map property owner they can place it back on the agenda. Letter to Administration pertaining to this matter. Mr. Hull informed the Commission that as requested, a letter was transmitted to the current Administration requesting discussion for a possible Executive Order with the Governor's office. He said due to the recent election and change in Administration, the Department would draft another letter to the newly elected Mayor once he is sworn into office and report Ms. Ono moved to receive the that at the next meeting. Letter to the Administration for Tax Map Key (TMK) (4)5-3- 003:029. Ms. Kanna seconded the motion. Motion carried 5:0. H.3. Review and discussion regarding access to Lawa`i Kai (Allerton's,) K61oa. Mr. Hull requested a deferral to the December meeting. He said due to Mr. Blake's absence Ms. Ono moved to defer there were no further updates to discuss. discussion on Lawa`i Kai to the December meeting. Ms. Taniguchi seconded the motion. Motion carried 5:0. New Business I.1. Review and discussion of ocean front parcel located approximately 480 feet west of the Kekaha Road and Kaumuali`i Highway intersection, further identified as Tax Map Key (For Action) (TMK) (4) 1-2-013:041. (Preliminary report received 11/10/16, Supplemental report No. 1 received 4/13/17) a. Report from the County Attorney pertaining to this matter. Mr. Hull stated that the County Council approved this recommendation and a purchase contract was signed on November 5, 2018. He said it's in escrow and estimated 60 days to close. With no further questions from the Commission, Mr. Hull asked for a motion to Ms. Kanna moved to receive receive. the report from the County Public Access, Open Space & Natural Resources Preservation Fund Commission Open Session November 8, 2018 Page 4 SUBJECT DISCUSSION ACTION Attorney on Tax Map Key (TMK) (4)1-2-013 :041. Ms. Ono seconded the motion. Motion carried 5:0. I.2. Review and update of a 0.2764 acre parcel located in Hanapepe Ahupuaa, Kona Moku, further identified as Tax Map Key (TMK) (4)1-8-008:065. (Preliminaryreport 2/8/18; Supplemental report No. 1 received 4/12/18, Supplemental report No. 2 received 8/09/18) a. Supplemental report No. 3 pertaining to this matter. Ms. Sadora read portions of Supplemental Report No. 3 for the record. (Document on file) Mr. Hull said the public voted in favor of adding improvements to the use of Open Space funds, and if this parcel is acquired, funds could be used to erect a plaque to memorialize the history of this property. Review and discussion of a 0.2867 acre parcel located in Hanapepe, Hanapepe Ahupuaa, Kona Moku, further identified as Tax Map Key (� TMK) (4)1-8-008:07. (Preliminary report 2/8/18; Supplemental report No. 1 received 4/12/18, Supplemental report No. 2 received 8/9/18) a. Supplemental report No. 3 pertaining to this matter. Mr. Hull said the report was almost identical to the previous item's report with the exception of acreage size and TMK. He waived the reading of Supplemental Report No. 3 and Ms. Hayashi moved for an recommended a motion for an open ended deferral. open-ended deferral for Tax Map Key (TMK) (4)1-8- 008:07. Announcements Mr. Hull announced that the Charter Amendment to add improvements for Open Space funds passed and the Department would work to draft an Ordinance, which is the second step required to allow use of Open Space funds for improvements. He said Ms. Sadora would begin to form a list of accesses; however, if the Commission had particular ones to recommend, he suggested they forward that information to him. Mr. Hull said they could possibly identify up to a dozen accesses to begin improvements and demarcation for public use. Ms. Sadora shared that the West Kauai Community Plan will hold public workshops for shared spaces next week Tuesday and Wednesday. Mr. Hull said shared spaces could potentially become an Open Space acquisition and encouraged the Commission to attend the workshops. Next Meeting Next scheduled meeting date is Thursday, December 13, 2018, at 1:00 p.m. Date and Agenda Topics Chair Kimura asked that the next agenda include a follow-up on the letter to the newly elected for Discussion Mayor for assistance in a possible Executive Order for the Kalihiwai parcel. Chair Kimura requested for the process needed to update Mayor Kawakami on the Commission's progress and list of priorities. Mr. Hull said it would be the responsibility of the Planning Director and Deputy Planning Director to brief the newly elected Mayor. Chair Kimura requested the list be placed on the next agenda. Chair Kimura asked for clarification on the meeting times, to which Mr. Hull confirmed that there would be no changes to the schedule.
