HomeMy WebLinkAboutResolution No. 2019-44COUNTY COUNCIL COUNTY OF KAUA’I ~&L&~O1Ut1OIINO.2019-44 RESOLUTION ESTABLISHING TWO CROSSWALKS AND REPEALING AN EXISTING CROSSWALK ON KEKAHA ROAD IN THE VICINITY OF KEKAHA ELEMENTARY SCHOOL, WAIMEA DISTRICT,COUNTY OF KAUA’I WHEREAS,Chapter 16,Article 2 of the Kaua’i County Code 1987,as amended,authorizes the County Council to:determine and designate the type of all official traffic control devices;create,define,re-define,eliminate,or change all traffic lanes and crosswalks,and designate the type of markings or signs to be placed and maintained for the identification of those zones or areas;and WHEREAS,Kekaha Road is located in the Waimea District,County of Kaua’i, State of Hawai’i;and WHEREAS,the Department of Public Works,based on an engineering and traffic investigation,has recommended that two marked crosswalks be established across Kekaha Road in the vicinity of Kekaha Elementary School;now,therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF KAUA’I,STATE OF HAWAI’I,THAT: SECTION 1.Resolution No.138 (1954),Section 2,Item 1, Waimea District,Kekaha,is hereby repealed in its entirety as follows: “[(1)Across Kekaha Road,approximately 425 feet Westerly from its intersection with the centerline of Alae Road.]” SECTION 2.A marked pedestrian crosswalk is hereby established across Kekaha Road approximately 270 feet west of its centerline intersection with ‘Alae Road,as shown on the map attached hereto as Exhibit “A”and incorporated herein by reference. SECTION 3.A marked pedestrian crosswalk is hereby established across Kekaha Road approximately 520 feet west of its centerline intersection with ‘Alae Road,as shown on the map attached hereto as Exhibit “A”and incorporated herein by reference. SECTION 4.The Department of Public Works shall install appropriate signs, markings,and/or traffic control devices at the crosswalks established herein in accordance with the provisions provided by law. SECTION 5.Any person convicted of violating any provision of the Traffic Code of the County of Kaua’i,Chapter 16,Kaua’i County Code 1987,as amended,shall be subject to the penalties prescribed in Section 16-21.6. SECTION 6.This Resolution shall take effect upon its approval and the installation of appropriate signs,markings,and/or traffic control devices.
