COMMITTEE OF THE WHOLE
March 16, 2016
A meeting of the Committee of the Whole of the Council of the County of Kaua`i,
State of Hawaii, was called to order by Mel Rapozo, Council Chair, at the Council
Chambers, 4396 Rice Street, Suite 201, Lihu`e, Kaua`i, on Wednesday,
March 16, 2016, at 3:19 p.m., after which the following Members answered the call of
the roll:
Honorable Mason K. Chock
Honorable Gary L. Hooser
Honorable Ross Kagawa
Honorable Arryl Kaneshiro
Honorable KipuKai Kuali`i
Honorable JoAnn A. Yukimura (present at 3:24 p.m.)
Honorable Mel Rapozo
The Committee proceeded on its agenda item, as shown in the following
Committee Report, which is incorporated herein by reference:
CR-COW 2016-04: on Bill No. 2614, Draft 2 A BILL FOR AN ORDINANCE TO
AMEND CHAPTER 3, KAUAI
COUNTY CODE 1987,AS AMENDED,
BY ADDING A NEW ARTICLE 6,
RELATING TO THE REGISTRATION
OF LOBBYISTS (Approved as
Amended.)
The Committee proceeded on its agenda item as follows:
Council Chair Rapozo: I am going to ask that we do the Executive
Session (ES) right here. I do not anticipate a very long Executive Session. We are
not bringing Department of Public Works back, right, just the County Attorney? I
do. I do have something to discuss that I want you folks to hear from the County
Attorney because of the misstatements made this morning on the floor. I want you
folks to hear it.
Councilmember Kuali`i: It is still in Executive Session?
Council Chair Rapozo: Yes. I am just asking if we can just have it in
here. You want to go in the back room? Okay. If you can read us into Executive
Session, please.

ES-839 Pursuant to Hawai`i Revised Statutes (HRS) Sections 92-4
and 92-5(a)(4), and Kauai County Charter Section 3.07(E), the Office of the County
Attorney, on behalf of the Council requests an Executive Session to brief the Council
relating to the Management Advisory Report for Fiscal Year Ended June 30, 2015,
Current Findings and Recommendations, 2015-003 (Improve Monitoring of
Delinquent Receivable Accounts), and related matters. This briefing and
consultation involves consideration of the powers, duties, privileges, immunities,
and/or liabilities of the Council and the County as they relate to this agenda item.
Councilmember Kagawa moved to convene in Executive Session for ES-839,
seconded by Councilmember Chock.
Council Chair Rapozo: Nobody in the public. Any further discussion?
If not, roll call.
The motion to convene in Executive Session for ES-839 was then put, and
carried by the following vote:
FOR EXECUTIVE SESSION: Chock, Hooser, Kagawa,
Kaneshiro, Kuali`i, Yukimura,
Rapozo TOTAL— 7,
AGAINST EXECUTIVE SESSION: None TOTAL— 0,
EXCUSED & NOT VOTING: None TOTAL— 0,
RECUSED & NOT VOTING: None TOTAL— 0.

Council Chair Rapozo: With that, thank you very much. That
concludes the formal meeting. Mr. BC, you are free to leave. Thank you.
There being no further business, the meeting was adjourned at 4:51 p.m.
