HomeMy WebLinkAbout07/13/2016 Committee of the Whole minutes MINUTES COMMITTEE OF THE WHOLE July 13, 2016 A meeting of the Committee of the Whole of the Council of the County of Kaua`i, State of Hawaii, was called to order by Mel Rapozo, Council Chair, at the Council Chambers, 4396 Rice Street, Suite 201, Lihu`e, Kauai, on Wednesday, July 13, 2016, at 12:40 p.m., after which the following Members answered the call of the roll: Honorable Mason K. Chock Honorable Gary L. Hooser Honorable Ross Kagawa Honorable Arryl Kaneshiro Honorable KipuKai Kualii Honorable JoAnn A. Yukimura Honorable Mel Rapozo ES-858 Pursuant to Hawaii Revised Statutes (HRS) Sections 92-4, 92-5(a)(2), 92-5(a)(4), and Kaua`i County Charter Section 3.07(E), the Office of the County Attorney, on behalf of the Kauai County Council, requests an Executive Session to brief the Committee of the Whole on matters regarding the Notice of Violation and Order (NOVO) from the State of Hawaii Department of Health, Clean Water Branch for National Pollutant Discharge Elimination System (NPDES) Permit related violations and penalties at four (4) refuse transfer stations, and related matters. The briefing and consultation involves consideration of the powers, duties, privileges, immunities, and/or liabilities of the Council and the County, as well as, the consideration of matters affecting privacy related to the evaluation, dismissal, or discipline of any officer or employee related to this agenda item. (This item was Deferred.) Council Chair Rapozo: As far as the Executive Session item that is posted for today, I am not sure if the County Attorney was ready today. You can just give me a nod of the head. Would anybody object to deferring this Executive Session matter? Does the Administration have a problem with deferring this item? If not, I just wanted to do that now so that when we come back from lunch, everyone knows that we are not going to convene in Executive Session today. We will just entertain the motion to defer for two (2) weeks if nobody has any objections. Is there anyone in the audience wishing to testify? If not, may I have a motion? Councilmember Yukimura moved to defer ES-858, seconded by Councilmember Kagawa, and unanimously carried. There being no objections, the Committee recessed at 12:41 p.m., to convene in the Planning Committee Meeting. The meeting was called back to order at 3:48 p.m. COMMITTEE OF THE WHOLE 2 JULY 13, 2016 There being no further business, the meeting was adjourned at 3:48 p.m. Respectfully submitted, Codie K.
