COUNCIL MEETING 2 MAY 19, 2015 C 2015-149 Communication (04/29/2015) from Councilmember Kuali`i, providing written disclosure of a possible conflict of interest and recusal, regarding the grant application by the Office of the Prosecuting Attorney for the Kauai Victim Witness Assistance Program 16-VW-03 Year 1, due to his employment with the YWCA of Kaua`i: Councilmember Kuali`i moved to receive C 2015-149 for the record, seconded by Councilmember Chock, and unanimously carried. C 2015-150 Communication (05/08/2015) from the Mayor, transmitting for Council consideration, pursuant to Sections 89-10(b) and 89C-5, Hawai`i Revised Statutes (HRS), the cost items for the Hawai`i Government Employees Association (HGEA) Bargaining Units 2, 3, and 4 between July 1, 2015 and June 30, 2017, pursuant to Section 19.13(B) of the Charter of the County of Kaua`i, as well as Unit 14 costs which are based on the Unit 3 contract pending Unit 14 negotiations; the negotiated wages are in accordance with the procedures contained in Chapter 89, HRS: Councilmember Kuali`i moved to receive C 2015-150 for the record, seconded by Councilmember Chock, and unanimously carried. COMMUNICATIONS: C 2015-151 Communication (04/24/2015) from the Executive on Transportation, requesting Council approval to receive, indemnify, and expend a Federal Transit Administration (FTA) Section 5311 grant, in the amount of $1,040,000, for operational expenses for the County Transportation Agency, to fund the 50% grant portion of wages, hourly pay, and fringe benefit line items for bus drivers: Councilmember Kuali`i moved to approve C 2015-151, seconded by Councilmember Yukimura, and unanimously carried. C 2015-152 Communication (04/28/2015) from the Prosecuting Attorney, requesting Council approval for the following: 1. Apply for, receive, and expend state funds, in the amount of $37,214, to fund one (1) Victim / Witness Trainee for the period of July 1, 2015 to September 1, 2015, one (1) Victim / Witness Counselor I for the period of September 2, 2015 to September 15, 2015, and one (1) Victim / Witness Trainee for the period of January 1, 2016 to June 30, 2016, and fringe benefits, for the Kaua`i Victim Witness Assistance Program 16-VW-03 Year 1, for the term July 1, 2015 through June 30, 2016; and 2. Indemnify the State of Hawai`i Department of the Attorney General. COUNCIL MEETING 3 MAY 19, 2015 Councilmember Chock moved to approve C 2015-152, seconded by Councilmember Kaneshiro. Council Chair Rapozo: Councilmember Kuali`i. Councilmember Kuali`i: I have one quick thing about process. I thank staff for automatically submitting a letter for me because Young Women's Christian Association (YWCA) is mentioned in the content of this grant. However, I see this funding as just primarily going to the Office of the Prosecuting Attorney (OPA) for positions within their office. In the documentation on page 2, it talks about agencies and organizations that participate with the Victim-Witness Program, and it lists about ten (10) to twelve (12) different organizations, including the YWCA. I do not see this as a reason to recuse myself, so I am not recusing. Council Chair Rapozo: Thank you. Any other discussion? The motion to approve C 2015-152 was then put, and unanimously carried. C 2015-153 Communication (04/28/2015) from the Director of Economic Development, requesting Council approval to apply for, receive, and expend an estimated amount of $10,000 from the State of Hawai`i Department of Labor and Industrial Relations (DLIR), to assist the County of Kaua`i in working with the State of Hawai`i Department of Education (DOE) — Future Farmers of America (FFA) programs at Kaua`i High School and Waimea High School in providing summer internship programs for students to work on Kaua`i farms, ranches, and agricultural-related businesses: Councilmember Kuali`i moved to approve C 2015-153, seconded by Councilmember Kaneshiro. Council Chair Rapozo: Councilmember Yukimura. Councilmember Yukimura: I notice that there is no copy of the grant application or even a description of how the money will be spent, and I would like to ask that...I do not want to stop the approval today, but I do want to get the details about how that money is going to be spent and what outcomes they are expecting. Then I would like a final report after the grant has been expended to see what the results were. Council Chair Rapozo: Okay. Any other discussion? The motion to approve C 2015-153 was then put, and unanimously carried. Councilmember Yukimura: Mr. Chair, just to clarify, it is a two (2) part report. I presume they have a grant application, or they will soon, so I would like to get that as soon as it is available, and then at the end. Council Chair Rapozo: Okay. Councilmember Yukimura: Thank you. C 2015-154 Communication (04/28/2015) from the Director of Economic Development, requesting Council approval to apply for, receive, and expend $20,000 COUNCIL MEETING 4 MAY 19, 2015 for Calendar Year 2015, from the Hawai`i Tourism Authority (HTA), for the 2015 County of Kaua`i Harbors Greeting Program: Councilmember Kuali`i moved to approve C 2015-154, seconded by Councilmember Kaneshiro. Council Chair Rapozo: Discussion? Councilmember Yukimura. Councilmember Yukimura: I want to make the same request for that, too. Council Chair Rapozo: This would be for the Harbors Greeting. Councilmember Yukimura: Right. Council Chair Rapozo: That is an ongoing program. Councilmember Yukimura: Is it? Council Chair Rapozo: It is. Councilmember Yukimura: Anyway, just a report of how it is going to be expended, and then the results. Thank you. Council Chair Rapozo: Okay. The motion to approve C 2015-154 was then put, and unanimously carried. C 2015-155 Communication (05/07/2015) from the Mayor, submitting his supplemental budget communication for Fiscal Year 2015-2016 and proposed amendments to the budget bills, pursuant to Section 19.02A of the Kaua`i County Charter. Council Chair Rapozo: Can I get a motion? Councilmember Kuali`i: To approve? Council Chair Rapozo: No, we need to set a public hearing for May 27th. Councilmember Kuali`i moved to schedule a public hearing for May 27, 2015 at 8:30 a.m., and refer C 2015-155 to the June 3, 2015 Council Meeting, seconded by Councilmember Chock, and unanimously carried. Council Chair Rapozo: Next item. C 2015-156 Communication (05/01/2015) from the Director of Economic Development, requesting Council approval to apply for, receive, and expend an estimated amount of $25,000 from the State of Hawai`i Department of Business, Economic Development & Tourism (DBEDT), to study the potential for load shifting at County of Kaua`i water and wastewater facilities: Councilmember Kuali`i moved to approve C 2015-156, seconded by Councilmember Yukimura. Council Chair Rapozo: Discussion? Councilmember Yukimura. COUNCIL MEETING 5 MAY 19, 2015 Councilmember Yukimura: On this one, I am really wondering why it is the Office of Economic Development (OED) and not our Wastewater Division that is applying for the moneys. I have no idea what "load shifting" is and I would like to request that this be put to the end of the calendar so we can get some explanation. Council Chair Rapozo: I have the same question. I have no clue why Economic Development is funding a Public Works project. The other two (2) is economic development or tourism, but this is...let us see if we can get somebody over here to discuss that. We can do minimal discussion or have them come over with some kind of written justification and we can move forward. Otherwise, we will send it back to the Committee. Councilmember Yukimura: Can we ask both the Wastewater Division and OED to come? Council Chair Rapozo: Yes, I would be surprised if OED can explain this load shifting at a sewer. Anyway, let us move this as well and let us see if we can get those people here. Councilmember Kuali`i: Do we need a motion for that? Council Chair Rapozo: We will just move forward. Ben, are you here for the load shifting at the Wastewater facilities? You are? Okay, that confuses me even more because you are energy, but we will suspend the rules with no objections. There being no objections, the rules were suspended. BENJAMIN SULLIVAN, Energy and Sustainability Coordinator: To explain this project briefly, it is collaboration with the Department of Business, Economic Development & Tourism (DBEDT) in order to analyze the opportunity to shift loads across the County facilities, inclusive of Wastewater, Water, and other County facilities, with the intent of trying to enable utilization of more photovoltaic (PV) energy. What underlies that is that the real value creation for photovoltaic energy is not putting in the panels; it is having the load available when the sun is shining. This study is about looking at how our loads align already with photovoltaic energy, and then also looking at how we can put even more of our electricity use in that sector, in-line with PV availability. The reason that is of value is because it is lower cost energy, mitigates the need for additional storage in order to try to use that energy some other time, and it helps us basically use more renewable energy. I can take questions or go into more detail, whatever is desired. Council Chair Rapozo: We will go with questions. Councilmember Yukimura. Councilmember Yukimura: Ben, I think you have to back up a little bit because I do not understand what you just said. I heard you say "exclusive of Wastewater." Mr. Sullivan: No, it is inclusive. Councilmember Yukimura: Okay, so is this for the whole County? Mr. Sullivan: Yes. COUNCIL MEETING 6 MAY 19, 2015 Councilmember Yukimura: For the County's entire electrical load? Mr. Sullivan: It is for the County operations. It is not inclusive of the entire island. It is County operations only. Councilmember Yukimura: Right, so it is all of County operations, our load... Mr. Sullivan: Right. Councilmember Yukimura: Do you know what that is? Mr. Sullivan: Well, we used roughly twenty million (20,000,000) kilowatts a year. Councilmember Yukimura: Yes, and it peaks at different times. Mr. Sullivan: That is correct. We are in the process already of establishing load profiles for various departments and even various meters. For example, when you look at the Department of Water (DOW), they have pumps that go on and off, in order to fill the tanks that are adjacent to those systems. The exploration in this study will be whether we can time the usage of those pumps to be more in-line with the availability of the sunshine through photovoltaics. In the case of Wastewater, it is a little more complicated because it is not just a simple on/off system. It is obviously a very complex biological process that is happening at the wastewater plants. We will probably need a little bit of outside help to determine where we might have opportunities to shift the load, but we are interested in finding out what those are. We think it is an opportunity. Councilmember Yukimura: What is the distinction between "outside help" and "inside help?" Mr. Sullivan: Well, certainly part of this study is going to be completed within the Office of Economic Development. We can analyze loads and we can look at simple pumps and things like that and determine what opportunities there are for simple shifts and control strategies working with the Department of Water, obviously, and working with Wastewater. When you get into analyzing a wastewater plant on how it operates and proposing changes to how a wastewater plant operates, it is complex enough and there is enough regulatory concern that we do not feel that we have the expertise in-house to take that task on ourselves, so we anticipate the need for outside expertise to help us with that. Councilmember Yukimura: So twenty thousand dollars ($20,000) is going to pay for what? Mr. Sullivan: It is twenty-five thousand dollars ($25,000) and basically we are going to get as far as we can with it. This is money that was offered up by the State to do an exploration. I do not know that it will be comprehensive in all encompassing, but we are going to get as far as we can. What we hope is that there will be enough information there to lead us to obvious next steps. Is there a question? COUNCIL MEETING 7 MAY 19, 2015 Councilmember Yukimura: Yes, I still do not know what you are using the twenty-five thousand dollars ($25,000) for. Mr. Sullivan: Okay, so right now, what we have outlined is the possibility of getting an intern in our office at about ten thousand dollars ($10,000) and that is an estimate, in order to help us do some of the load analysis, so that would be like an engineering student or some sort. Another ten thousand dollars ($10,000) at this point, and again, just an estimate is looking at getting an outside wastewater consultant to help us look at the wastewater plants and which ones might have the best opportunity for load shifting. We want to put the balance towards augmenting our energy data collection. We actually have an item in the budget that was passed already that includes the annual cost of our energy analysis software that we maintain, and this money would go towards augmenting that and maybe getting more granularity from it so that we can complete the study more thoroughly. Council Chair Rapozo: Do you have a write-up that you are sending over to the State? Mr. Sullivan: I do and I thought it was attached to what was sent over to you guys. Council Chair Rapozo: Staff, is this all we got? Was there an attachment to this? Normally it is attached. Councilmember Yukimura: That is why we do not know what is going on. Mr. Sullivan: Right. Just for context, unfortunately I guess the good and bad about this is that the conversation with the State was very rapid, so the State basically said, "We can make this money available. What kinds of things are you guys looking at?" We arrived in discussions at this opportunity because they have an interest in it as well, and they wanted to close it out really quick. We did have to go ahead and proceed with just outlining the scope, and they have already turned around and issued a purchase order (PO). There was not any process really that allowed us to come and get full approval and whatnot. Certainly, if the Council determines that it is money they do not want to accept, then that is up to you. Councilmember Yukimura: I think the Council wants to do everything possible to see how we can lower our energy costs, but right not without any information, it is really hard to know what we are funding and we feel it is our responsibility to find out before we approve it. Mr. Sullivan: Sure. Councilmember Yukimura: It sounds like the State is just trying to encumber some money at the end of the fiscal year. It is great if we can take advantage of it, but we just do need kind of a...to understand, so that is why not having any write-up makes it really hard for us. Mr. Sullivan: I have twelve (12) copies of the write-up that we provided to the State. COUNCIL MEETING 8 MAY 19, 2015 Councilmember Yukimura: Can you give us a copy of that? Mr. Sullivan: I actually have twelve (12) as well of the PO that they issued back. I do not know if that helps. Councilmember Yukimura: I have a few more questions, but I do not want to monopolize the time, Chair. You can go around and see if others have questions. Council Chair Rapozo: I do not know if anybody else has any other questions. I share those concerns. I guess what I do not understand is that it looks like you sent this—well, this write-up was done in April on the 15th, and only today it is on the agenda. I guess I am curious as to why. Mr. Sullivan: What is today? May 19th. Council Chair Rapozo: It is over a month ago. Normally what happens is that departments come to us and ask if it is okay to apply, and then we have discussion. The one thing that bothers me and it is nothing personal and it is not you, because it happens to everybody in this County, but they come here and say, "We need an approval because it is kind of time sensitive," and that bothers me because number one, I do not understand what this is. Some people think that free money is good. This County is a great example of going after money without projects. I am not saying this is one of them, but I do not understand this. April 15th...maybe we should have had this briefing before. This is awkward where we are being asked to approve a twenty-five thousand dollar ($25,000) grant and the purchase order is already cut from the State. I do not know. Maybe the State is generous, but that kind of troubles me. It is like we were left completely out of the loop and even until today it is confusing. I do not know if anyone has any questions, but if no one has questions, we can move this and take some time to go over the documents. Obviously, it is not time sensitive because you already got the PO. It is not like we have to approve this today. Councilmember Yukimura. Councilmember Yukimura: I have a few more questions if it is alright. Council Chair Rapozo: Sure. Go ahead. Councilmember Yukimura: Ben, the outcome of this project is going to be to understand better the load shifting potential of the County. Mr. Sullivan: Correct. Councilmember Yukimura: This is in anticipation of the pump storage that Kaua`i Island Utility Cooperative (KIUC) is going to do because we are a major user of the electricity and if we can move our load with our internal pump storage capacity...it is not actually pump storage; it is internal load management capacity...then we will be better able to support KIUC in their load management? Mr. Sullivan: This is not related to the pump storage project that KIUC is taking on. This is simply related to the true cost of energy on a time of use basis. What this is about is that in reality, electricity is currently on average cheaper during the middle of the day than it is at night, and that is because there is a larger percentage of energy being generated by fossil fuel in the evening time or by higher cost energy sources; where as in the middle of the day, obviously COUNCIL MEETING 9 MAY 19, 2015 as you know, photovoltaic energy is providing some of the lowest cost, lowest carbon, most stable priced energy that we can get. There is an advantage to us in shifting load. One of the conversations that are a possible outcome of this is moving towards a time of use rate with KIUC. Councilmember Yukimura: I have some background in this and the rest of the Councilmembers do not...I do not think...I do not know...maybe they do...I am assuming. I think you kept interchangeably using the words "lowest costs" versus "lowest price," because right now the cost is the same across time, right? Mr. Sullivan: At this moment it is, but if you look at it as an average it is now. We can reasonably foresee that the price of oil is going to go up, whereas the price of solar is not. Councilmember Yukimura: Right, but those differences have not been included in the pricing right now. Everybody pays the same for a kilowatt of energy in the day as they do at night. Mr. Sullivan: Correct. Councilmember Yukimura: But KIUC is moving towards reflecting a more accurate pricing so that if people use energy during the day, photovoltaic, or...they want to lessen the peaks, they will encourage people to use energy late at night, right? Mr. Sullivan: I want to be careful not to speak for KIUC. Council Chair Rapozo: I do not want to get into the discussion of solar on Kaua`i right now because it is not on the agenda. On the agenda is this grant application. Councilmember Yukimura: But Chair, I am trying to understand how this is...I hear that we are doing this in the—right now, we do not get charged less money if we use it during the day than at night, but you are anticipating that at some point the pricing might change so that if we could shift loads, we could have a lower cost of energy. Is that correct? Mr. Sullivan: It is our view that this study will actually yield a conversation that may lead us in that direction, yes. Without this information, it is really hard for us to just tell KIUC, "Hey, we think we should go this way." We need to understand it better, and in that way, we can then make an argument if we feel it is right thing to do to move in that direction. Council Chair Rapozo: So your study will be limited to just the Water and Wastewater facilities? Mr. Sullivan: No, actually the original write-up said just Water and Wastewater and that will honestly be, I think, where most of the load shifting can be achieved, but we broadened it when we finalized it with the State to include all facilities because it really does not make sense not to; however, I do expect that most of the opportunities would be Water and Wastewater. Council Chair Rapozo: Okay. Any other questions? Councilmember Yukimura. COUNCIL MEETING 10 MAY 19, 2015 Councilmember Yukimura: So it is both Water and Wastewater that have the potential, and that actually is our biggest electrical costs right now for the County. Okay. I only have one comment and this is for staff to get a memorandum over to the Administration that if we do not have the write-up, attachment, and grant application, then do not put it on the agenda because it is difficult and I do not like having these discussions at the Council Meeting. It seems like a really good program and something that could help us a lot, but it is just difficult to have the discussions on the Council floor. I was out of the room and I apologize, but my vote was counted as a positive so that I am able to move to reconsider. There are some discrepancies in the report out on the results of this workshop and I have not had the time to actually review the minutes, so I would like to have the time to do that. We would reconsider because we did a motion to approve, and then move to defer so that I could have time, two (2) more weeks. Council Chair Rapozo: Okay. Any further discussion?
