JANUARY 21, 2016
The Special Council Meeting of the Council of the County of Kaua`i was called
to order by Council Chair Mel Rapozo at the Council Chambers, 4396 Rice Street,
Suite 201, Lihu`e, Kauai, on Thursday, January 21, 2016 at 2:55 p.m., after which
the following Members answered the call of the roll:
Honorable Mason K. Chock
Honorable Gary L. Hooser
Honorable Ross Kagawa
Honorable Arryl Kaneshiro
Honorable KipuKai Kuali`i
Honorable JoAnn A. Yukimura
Honorable Mel Rapozo (excused at 4:23 p.m.)
APPROVAL OF AGENDA.
Councilmember Kagawa moved for approval of the agenda as circulated,
seconded by Councilmember Chock.
Council Chair Rapozo: Discussion? Public testimony?
There being no objections, the rules were suspended to take public testimony.
There being no one to provide testimony, the meeting was called back to order
and proceeded as follows:
The motion for approval of the agenda as circulated was then put, and
unanimously carried.
Council Chair Rapozo: Can we have the only item on the agenda,
please?
EXECUTIVE SESSION:
ES-831 Pursuant to Hawaii Revised Statutes (HRS) Sections 92-4 and
92-5(a)(2), (4), and (8), the purpose of this Executive Session is to consider matters
that require confidentiality under state law, to wit, the hiring of a County Auditor,
including terms and conditions of employment. The further purpose of this Executive
Session is to meet with the Council's legal counsel on questions and issues relating to
the Council's powers, duties, privileges and immunities and/or liabilities, claims
and/or potential claims, as such powers, duties, privileges and immunities and/or
liabilities, claims and/or potential claims relate to the foregoing item, and to take
such action as the Council deems appropriate.
SCOTT K. SATO, Deputy County Clerk: This is a motion to go into
Executive Session.
Council Chair Rapozo: Can I get a motion?

Councilmember Yukimura moved to convene in Executive Session for ES-831,
seconded by Councilmember Chock.
Council Chair Rapozo: Discussion or public testimony?
Councilmember Kagawa.
Councilmember Kagawa: Are we going to break now and go into
Executive Session?
Council Chair Rapozo: No, we are going to recess this, and we will
take this up at the end of the day.
Councilmember Kagawa: Is there any urgent reason to discuss this
today because we are almost at 4:30 p.m., we have your item, which is going to take
a while, the County Manger item, and I am just thinking to avoid staff overtime if
this can be pushed another week? I do not know. That is my suggestion.
Councilmember Yukimura: Chair, I do not think it would take long, but I
think we need to take some action to initiate a process.
Council Chair Rapozo: We will recess it now, then we will finish up
this item here, and then we will make that decision. Again, this item, it sounds like
it is going to be deferred. So let us try to get the public testimony in. I think it is
clear what we are trying to do here. Any other comments or discussion? Seeing none,
the motion is to go into Executive Session. Roll call.
The motion to convene in Executive Session for ES-831 was then put, and
carried by the following vote:
FOR EXECUTIVE SESSION: Chock, Hooser, Kagawa,
Kaneshiro, Kuali`i, Yukimura,
Rapozo TOTAL — 7,
AGAINST EXECUTIVE SESSION: None TOTAL— 0,
EXCUSED & NOT VOTING: None TOTAL— 0,
RECUSED & NOT VOTING: None TOTAL— 0.
Mr. Sato: Seven (7) ayes.
Council Chair Rapozo: Thank you. With that, we will recess this
Special Council Meeting and go back to the Planning Committee. Thank you.
There being no objections, the Council recess at 2:58 p.m.
The meeting was called back to order at 4:23 p.m., and proceeded as follows:
(Council Chair Rapozo was noted as excused.)
Councilmember Kagawa: We already made a motion.
Councilmember Yukimura: Yes.
Councilmember Kagawa: Okay. So we are going to move into Executive
Session. Do we need to keep BC, Scott? No. BC, you are excused.

There being no objections, the Council convened in Executive Session.
ADJOURNMENT.
There being no further business, the Special Council Meeting adjourned at
4:23 p.m.
