MAY 24, 2016
The Special Council Meeting of the Council of the County of Kaua`i was called
to order by Council Chair Mel Rapozo at the Council Chambers, 4396 Rice Street,
Suite 201, Lihu`e, Kauai, on Tuesday, May 24, 2016 at 8:32 a.m., after which the
following Members answered the call of the roll:
Honorable Mason K. Chock
Honorable Arryl Kaneshiro
Honorable KipuKai Kuali`i
Honorable JoAnn A. Yukimura
Honorable Mel Rapozo
Excused: Honorable Gary L. Hooser
Honorable Ross Kagawa
APPROVAL OF AGENDA.
Councilmember Chock moved for approval of the agenda as circulated,
seconded by Councilmember Yukimura, and carried by a vote of 5:0:2
(Councilmembers Hooser and Kagawa were excused).
Council Chair Rapozo: Motion carried. Next item is C 2016-129, but
we will go into Executive Session first. Can you read us into Executive Session,
please?
EXECUTIVE SESSION:
ES-853 Pursuant to Hawai`i Revised Statutes (HRS) Sections 92-4 and
92-5(a)(4), and Kaua`i County Charter Section 3.07(E), the Office of the County
Attorney, on behalf of the Council, requests an Executive Session with the Council to
provide the Council with a briefing on the retention of Special Counsel services to
represent the County of Kauai in Arbitration with the Hawai`i Fire Fighters
Association, and related matters. This briefing and consultation involves the
consideration of the powers, duties, privileges, immunities, and/or liabilities of the
Council and the County as they relate to this agenda item.
Council Chair Rapozo: Can I get a motion, please?
Councilmember Chock moved to convene in Executive Session for ES-853,
seconded by Councilmember Kaneshiro.

Council Chair Rapozo: Is there any discussion? Is there any public
testimony?
There being no objections, the rules were suspended to take public testimony.
There being no one present to provide testimony, the meeting was called back
to order, and proceeded as follows:
Council Chair Rapozo: Roll call.
The motion to convene in Executive Session for ES-853 was then put, and
carried by the following vote:
FOR EXECUTIVE SESSION: Chock, Kaneshiro, Kuali`i,
Yukimura, Rapozo TOTAL — 5,
AGAINST EXECUTIVE SESSION: None TOTAL — 0,
EXCUSED & NOT VOTING: Hooser, Kagawa TOTAL — 2,
RECUSED & NOT VOTING: None TOTAL — 0.
JADE K. FOUNTAIN-TANIGAWA, County Clerk: Five (5) ayes.
Council Chair Rapozo: With that, we will take a recess from the
agenda. We will go into Executive Session. I would assume that it will probably be
half an hour. Mauna Kea, is that about right? Okay. BC, we will back in half an
hour. Let us do this. Let us get back at 9:00 a.m.
There being no objections, the meeting recessed at 8:34 a.m.
The meeting reconvened at 9:10 a.m., and proceeded as follows:
Council Chair Rapozo: Can we have C 2016-129, please?
COMMUNICATION:
C 2016-129 Communication (05/17/2016) from the County Attorney,
requesting Council authorization to expend funds up to $50,000.00 for Special
Counsel services to represent the County of Kauai in Arbitration with the Hawai`i
Fire Fighters Association, and related matters: Councilmember Kuali`i moved to
approve C 2016-129, seconded by Councilmember Chock.
Council Chair Rapozo: Is there any discussion? Is there any public

to order, and proceeded as follows:

RECUSED & NOT VOTING: None TOTAL— 0.
Ms. Fountain-Tanigawa: Five (5) ayes.
Council Chair Rapozo: Thank you. With that, there is no further
business on the Special Council Meting agenda.
ADJOURNMENT.
There being no further business, the Special Council Meeting adjourned at
9:10 a.m.
