SEPTEMBER 21, 2016
A public hearing of the Council of the County of Kaua`i was called to order by
Mason Chock, Chair, Planning Committee, on Wednesday, September 21, 2016, at
1:30 p.m., at the Council Chambers, 4396 Rice Street, Suite 201, Historic County
Building, Lihu`e, and the presence of the following was noted:

Honorable Mel Rapozo (present at 1:32 p.m.)

The Clerk read the notice of the public hearing on the following:
"Bill No. 2636 — A BILL FOR AN ORDINANCE AMENDING
SUBSECTION 8-15.1(d)(7), KAUAI COUNTY CODE 1987, AS AMENDED,
RELATING TO ADDITIONAL DWELLING UNITS
(County of Kauai, Applicant),"
which was ordered to print by the Council of the County of Kauai on August 17, 2016,
and published in The Garden Island newspaper on August 25, 2016.

The hearing proceeded as follows:
SCOTT K. SATO, Deputy County Clerk: We have received one (1) written
testimony in support and have two (2) registered speakers. The first registered
speaker is Rebecca Hartshorn, followed by Jesse Fukushima.
Committee Chair Chock: Have a seat here and press the button on the

REBECCA HARTSHORN: Hello, I am Rebecca Hartshorn. I am a
homeowner at 6611 Kipapa Road in Kapa`a. I co-own the home with my husband and
parents, most of whom are in the room. I am for the proposed bill, Bill No. 2636. On
a side note, I was unclear if it was for Additional Dwelling Units (ADUs) that expired
or when they expired. I think ours may have expired in 2009, so I do not know if we
are even candidates for this Bill. I recommend that all existing ADU Facilities

Clearance Forms dated back to 2004, or whenever, be candidates for obtaining
recertification and be included in the expiration date extension.
My parents are aging and their health is declining. At this time, my husband
and I live in the existing home with our three (3) kids and my two (2) parents. It is
very difficult to have so many people living in one (1) home. It is necessary to have
my parents close to care for them. My mom has survived a liver transplant, breast
cancer, and skin cancer, which is awesome. She is currently fighting a debilitating
fungus in her lungs. She is more susceptible to get extreme health conditions because
of her anti-rejection medicine to keep her body from rejecting her new liver. If we
were able to get our 2004 ADU Facilities Clearance Form recertified, we could build
my parents a home on our land, enabling us to better care for them.
I really recommend Bill No. 2636 pass and includes ADU Facilities Clearance
Forms dated back to 2004. It would help my family so much. Attached is a copy of
the completed ADU Facilities Clearance Form, which we received when we purchased
our home. Thank you for the opportunity to share my opinion.

Ms. Hartshorn: Yes.
Councilmember Kagawa: I would like to get more information.
Committee Chair Chock: We will probably be finishing soon, so please

JESSE FUKUSHIMA: Good afternoon, Planning Committee Chair,
and Members of the County Council. My name is Jesse Fukushima. As you well know,
I have always been in support, but I would ask with the passage on the final reading,
how much more time will it give the public to recertify? Is it one (1) month, three (3)
weeks, four (4) weeks? When do you intend to pass this part of the Bill?
Committee Chair Chock: Good question. I believe that was the question
that we were thinking of needing to amend moving forward. Now that it is in this
process, we will have to relook at it once we get it back in terms of timing.
Mr. Fukushima: My reason for asking is because I am under
the assumption that there is possibility of a month to register and I was thinking if
you could extend maybe another month because as we all know December is a very,

very busy month for many families. Folks going away and taking vacations. It is a
very busy month and I was wondering if this could be extended at least for a total of
sixty (60) days at the minimum.
