RESOLUTION PROPOSING A CHARTER AMENDMENT TO ESTABLISH
A COUNTY ROADS RESURFACING / RECONSTRUCTION BACKLOG
FUND
This purpose of this Resolution is to propose an amendment to the Charter of
the County of Kauai to establish a County Roads Resurfacing / Reconstruction
Backlog Fund.
The proposed Charter amendment would require that the Council
appropriate a minimum of one percent (1%) of the County's annual certified real
property tax revenues and a minimum of six percent (6%) of the annual transient
accommodations tax revenues to the County Roads Resurfacing / Reconstruction
Backlog Fund. Moneys in this fund shall be utilized to address the resurfacing,
repairs, or reconstruction of county roads.
At any given time, no more than one percent (1%) of this fund shall be used
for administrative expenses.
Any balance remaining in this fund at the end of any fiscal year shall not
lapse, but shall remain in the fund, accumulating from year to year, for a period of
twenty (20) years from the date of establishment of this fund. Any moneys
remaining in the County Roads Resurfacing / Reconstruction Backlog Fund at the
expiration of the 20-year period shall be transferred and deposited into the General
Fund.
The Council shall by ordinance establish procedures for the administration
and priorities for the expenditure of moneys in this fund.
All interested persons who wish to present their comments may do so at the
public hearing. Written testimony prior to the hearing would be appreciated.
Written testimony can be submitted to the Office of the County Clerk, Council
Services Division by mail, facsimile, or via E-mail to counciltestimony @kauai.gov.
Copies of the proposed Resolution are available at the Office of the County Clerk,
Council Services Division.
(The Council Committee or Council may amend this Resolution at its
subsequent meetings. Meeting notices are posted at least 6 days in advance at the
County Clerk's Office and the public may also testify at any of these meetings.)
