RESOLUTION TO RECEIVE AND EXPEND A SPECIAL ALLOCATION OF
GRANT FUNDS FROM THE DEPARTMENT OF HOUSING AND URBAN
DEVELOPMENT, UNITED STATES OF AMERICA, AUTHORIZED BY THE
CORONAVIRUS AID, RELIEF, AND ECONOMIC SECURITY
ACT (CARES ACT) OF 2020 (PUBLIC LAW 116-136)
WHEREAS, the Assistant Secretary for Community Planning and
Development (Secretary) from the Department of Housing and Urban Development
(HUD), United States of America, is authorized to award Community Development
Block Grants (CDBG) with the primary objectives of developing viable communities
including decent housing and a suitable living environment and expanding economic
opportunities, principally for persons of low-and moderate-income; and
WHEREAS, the County of Kaua'i will receive a special allocation of
Community Development Block Grant Coronavirus (CDBG-CV) funds authorized by
the Coronavirus Aid, Relief, and Economic Security Act (CARES Act), Public
Law 116-136 which was signed by President Trump on March 27, 2020, to be used to
prevent, prepare for, and respond to the coronavirus (COVID-19) health crisis; and
WHEREAS, the CARES Act authorizes the Secretary to grant waivers and
alternative requirements to some statutes and regulations and adds additional
flexibility to both CDBG-CV and CDBG grant funds needed to expedite and facilitate
the use of funds to respond to the corona virus; and
WHEREAS, the County has accepted waivers and will implement flexibilities
to expeditiously allocate and/or reprogram CDBG-CV and CDBG funds, respectively;
now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF KAUA'I, STATE OF
HAWAI'I:
1. That Mayor Derek S.K. Kawakami or his designated representative, is
authorized to execute and submit a grant-agreement to HUD for the County's special
allocation of CD BG-CV funds to finance HUD-approved projects.
2. That the County Engineer, County Attorney, Planning Director,
Director of Economic Development, Director of Human Resources, Manager and Chief
Engineer for the Department of Water, Director of Finance, Director of Parks &
Recreation, Emergency Management Administrator, and Housing Director are
authorized to execute assurances or any document required by HUD in connection
with the special allocation or projects.
3. That the Housing Agency is authorized to receive and expend FOUR
HUNDRED TWELVE THOUSAND, NINE HUNDRED TWENTY-NINE AND
N0/100 DOLLARS ($412,929.00) of the County of Kauai's CDBG-CV special
allocation and reprogram FOUR HUNDRED SIXTY FIVE THOUSAND SEVEN
HUNDRED FIFTY-TWO AND N0/100 DOLLARS ($465,752.00) of unexpended
PY 19 CDBG funds for the following projects:
PUBLIC SERVICES:
a. COVID-19 Emergency Housing and Utilities Assistance $400,000.00
(Malama Pono Health Services & Family Life Center)
Pay for rent or mortgage and utilities for no more than three (3) months
on behalf of low-to moderate-income individuals or families who lost
their jobs, as a result of the COVID-19 pandemic.
b. Kiipuna Kare for Farmer Fare $150,000.00
(Office of Economic Development)
Purchase Kaua'i fresh grown produce from participating farmers to
provide produce bags to kupuna, free of charge to ensure food security
for the vulnerable population, while helping local farmers during the
COVID-19 pandemic.
PUBLIC FACILITIES:
a. Kauhale Project -Kaua'i $246,095.00
(Kaua'i County Housing Agency)
Purchase tiny homes based on the Kauhale (Hawaiian term for village)
concept as a cultural model of non-congregate shelter enabling safe
self-isolation that would otherwise be unavailable m group
encampments or traditional homeless shelters.
ADMINISTRATION:
a. CDBG-CV Administration $82,586.00
(Kaua'i County Housing Agency)
General program administration, project implementation and oversight,
compliance monitoring, evaluation, record-keeping and reporting.
TOTAL CDBG-CV AND CDBG FUNDING $878,681.00
4. That to ensure the performance of the County of Kaua'i's CDBG
Program in meeting CDBG timeliness regulations pursuant to 24 CFR 570.902, or
should any CDBG or CDBG-CV funds become available from cancelled or completed
projects, or by receipt of program income or revolving funds, or additional funding,
such funds may be reprogrammed in accordance with the requirements of the
County's Citizen Participation Plan, CDBG-CV waivers and/or CDBG flexibilities,
and prior approval from HUD.
BE IT FURTHER RESOLVED, that the County Clerk is hereby authorized
and directed to transmit a true copy of this Resolution to the County Housing Agency
for the U.S. Department of Housing and Urban Development.

*Beginning with the March 11, 2020 Council Meeting and until further notice,
