RESOLUTION TO APPLY FOR, RECEIVE, AND EXPEND AN
ALLOCATION OF GRANT FUNDS FROM THE UNITED STATES
DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT,
AUTHORIZED BY THE ADDITIONAL SUPPLEMENTAL
APPROPRIATIONS FOR DISASTER RELIEF ACT OF 2019
(PUBLIC LAW 116-20)
WHEREAS, the United States Department of Housing and Urban
Development (HUD) Assistant Secretary for Community Planning and
Development (Secretary) is authorized to award Community Development Block
Grants for Disaster Recovery (CDBG-DR) with the primary objectives of disaster
relief, long-term recovery, restoration of infrastructure and housing, economic
revitalization, and mitigation in the "most impacted and distressed" areas resulting
from a qualifying major disaster; and
WHEREAS, the County of Kauai was selected to receive an allocation of
CDBG-DR funds authorized by the Additional Supplemental Appropriations for
Disaster Relief Act of 2019 (2019 Appropriations Act), Public Law 116-20, which was
signed by President Donald J. Trump on June 6, 2019, to be used for disaster recovery
activities principally serving persons of low and moderate incomes; and
WHEREAS, the 2019 Appropriations Act authorizes the Secretary to grant
waivers and alternative requirements to some statutes and regulations and adds
additional flexibility to CDBG grant funds needed to expedite and facilitate the use
of funds to respond to unmet needs of disaster recovery following the flooding disaster
in April 2018; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF KAUAI,
STATE OF HAWAPI, that:
I. Mayor Derek S.K. Kawakami or his designated representative is authorized
to execute and submit an application for federal assistance followed by a
grant agreement to HUD for the County's allocation of CDBG-DR funds to
finance HUD -approved projects.
2. The County Engineer, County Attorney, Planning Director, Director of
Economic Development, Director of Human Resources, Manager and Chief
Engineer of the Department of Water Supply, Director of Finance, Director
J
of Parks & Recreation, Emergency Management Administrator, Executive
on Transportation, Fire Chief, Chief of Police, and Housing Director are
authorized to execute assurances or any document required by HUD in
connection with the allocation or projects.
3. The County Housing Agency is authorized to apply for, receive, and expend
NINE MILLION, ONE HUNDRED SEVENTY-SIX THOUSAND AND
N01100 DOLLARS ($9,176,000.00) of the County of Kaua`i's CDBG-DR
allocation for planning and development of affordable housing and
mitigation activities within the County of Kauai. Specific projects have not
yet been identified but will be selected pursuant to CDBG-DR — allowable
uses of funds and HUD approval of an amended action plan specifying
project selection and requiring public participation based on the County's
Citizen Participation Plan. Once the projects have been identified following
this process, threshold amounts for use of CDBG-DR funds are as follows:

4. To ensure the performance of the County of Kaua`i's CDBG-DR Program in
meeting CDBG-DR timely expenditures, or should any CDBG-DR or
Community Development Block Grant — Mitigation Funds (CDBG-MIT)
funds become available from cancelled or completed projects, or by receipt
of program income or revolving funds, or additional funding, such funds
may be reprogrammed in accordance with the requirements of the County's
Citizen Participation Plan, CDBG-DR waivers, and/or CDBG flexibilities,
and prior approval from HUD.
5. The County Clerk is hereby authorized and directed to transmit a copy of
this Resolution to the County Housing Agency (to then be submitted to the
U.S. Department of Housing and Urban Development).
This Resolution shall take effect upon its approval.
