KOLLAR, PROSECUTING ATTORNEY Tel (808) 241-1888 Fax (808) 241-1758 Grand Jury indicts three for gun, drug, kidnapping charges LIHU`E — A Fifth Circuit Grand Jury last week returned two Indictments charging Kevin Boggs, Leona Boggs, and Nicholas "Nico" McPeek with a total of 33 charges pertaining to multiple incidents occurring during January 2019. In the first indictment, concerning events alleged to have taken place on Jan. 6 and 13, 2019, Kevin Boggs is charged with Carrying or Use of a Firearm in Commission of a Separate Felony, two counts of Prohibited Possession of Firearm of Ammunition, two counts of Terroristic Threatening in the First Degree, Assault in the Second Degree, Unauthorized Entry into a Motor Vehicle in the First Degree, two counts of Kidnapping, two counts of Reckless Endangering in the First Degree, Robbery in the First Degree, Unauthorized Control of Propelled Vehicle, Promoting a Dangerous Drug in the Second Degree, Unauthorized Possession of Confidential Personal Information, Promoting a Detrimental Drug in the Third Degree, and Assault in the Third Degree. McPeek is charged in the same indictment with Carrying or Use of a Firearm in the Commission of a Separate Felony, Prohibited Possession of Firearm or Ammunition, Terroristic Threatening in the First Degree, Kidnapping, Accomplice to Terroristic Threatening in the First Degree, Accomplice to Kidnapping, Accomplice to Robbery in the First Degree, Accomplice to Unauthorized Control of a Propelled Vehicle, and Accomplice to Assault in the Third Degree. In the second indictment, the Grand Jury charged Kevin and Leona Boggs with seven charges alleged to have taken place on Jan. 17, 2019, including two counts of Promoting a Dangerous Drug in the Third Degree, two counts of Theft in the First Degree, and three counts of Prohibited Possession of Firearm or Ammunition. McPeek is being held on $100,000 in bail. Leona Boggs is being held on $100,000 in bail. Kevin Boggs is being held on $2 million in bail regarding these two indictments. Kevin Boggs is also being held on an additional total of $175,000 in bail for other cases and charges. The stolen vehicle from the Jan. 6 incident has not yet been recovered and Kauai police are seeking the public's help in locating it. The vehicle is described as a 2007 gray Ford F-150 truck, with license plate number KBD 381. Anyone with information about the vehicle's whereabouts is urged to call Police Dispatch at 241-1711. Anonymous tipsters can call Crime Stoppers Kauai at 246-8300. An indictment is an accusation of a crime returned by a Grand Jury upon a finding of probable cause.
