HomeMy WebLinkAbout15A2190 ASSISTANT CHIEF LIQUOR CONTROL INVESTIGATOR 20211028PART I DEPARTMENT OF HUMAN RESOURCES COUNTY OF KAUAI 15A2190 Class Specifications for the Class: AASSISTANT CHIEF LIQUOR CONTROL INVESTIGATOR EM-03, BU-13X Duties Summary: Plans, directs, and coordinates the licensing and enforcement functions of the County of Kauai Liquor Control Commission; serves as the principal assistant to the Director of Liquor Control; and performs other related duties as required. Distinguishing Characteristics: This class is distinguished by its responsibility for planning, directing, and coordinating all activities relating to the licensing and enforcement functions of the County of Kaua‘i Liquor Commission and serves as the principal assistant to the Director of Liquor Control. Examples of Duties: (The following are examples of duties and are not necessarily descriptive of any one position in this class. The omission of specific duties statements does not preclude management from assigning such duties if such duties are a logical assignment for the position). x Plans, directs, and coordinates all inspectional and investigative functions and activities relative to the enforcement of liquor laws and regulations; x Develops, recommends, implements, and amends programs, objectives, policies, and procedures within polices set by the Liquor Commission; x Formulates short and long range plans and goals, evaluates objectives and makes changes as necessary; x Establishes internal operating procedures for the execution of the enforcement and licensing function; x Plans and coordinates liquor law activities with other regulatory or law enforcement agencies; x Initiates studies of existing liquor laws, regulations, and policies and recommends revisions as needed; x Keeps abreast of laws and regulations related to liquor licensing and enforcement and reviews and comments upon proposed laws, rules, regulations and policies; x Directs and participates in studies relating to liquor industry trends and developments; PART I ASSISTANT CHIEF LIQUOR CONTROL INVESTIGATOR 2 15A2190 x May testify before legislative committees and County Council; x Attends Commission meetings to clarify and advise on enforcement and licensing matters; x May represent the department at public hearings, informational meetings, and other community or organization meetings; x Directs the in-service training of staff; x Directs staff in preparing for Commission meetings, in notifying applicants and licensees of actions taken and in following through on license suspensions and revocations; x Recommends the selection, promotion and discipline of employees and other personnel matters; x May act in the absence of the Director of Liquor Control, as assigned; and x Performs other related duties as assigned. Knowledge of: Principles and practices of supervision; laws, rules and regulations governing the manufacture, importation and sale of liquor in the County of Kaua‘i and the State of Hawai‘i; principles and techniques of inspection and investigation applicable to the work involved; standard methods used by business establishments for keeping records; rules of legal evidence and laws of arrest and seizure; court procedures; functions and jurisdictions of other enforcement agencies; report writing; public relations. Ability to: Plan, organize, direct and coordinate the work of others; interpret and apply pertinent laws, rules and regulations; formulate, develop and improve operational policies and procedures; obtain, analyze and evaluate facts and make sound decisions based thereon; maintain effective working relationships with the public and other governmental agencies; prepare clear and concise reports; conduct studies. ANDERSON Director of Human Resources Digitally signed by Annette Anderson Date: 2021.10.19 10:47:55 -10'00' PART II DEPARTMENT OF HUMAN RESOURCES COUNTY OF KAUAI 15A2190 Minimum Qualification Specifications for the Class: ASSISTANT CHIEF LIQUOR CONTROL INVESTIGATOR EM-03, BU-13X Training & Experience: A combination of education and experience substantially equivalent to graduation from an accredited college or university with a baccalaureate degree in public administration, business administration, criminal justice, law enforcement administration or a related field, and •four (4) years of professional work experience in the examination, enforcement, interpretation and/or application of laws, ordinances, rules and regulations and/or policies and procedures in a liquor control program or four (4) years of professional work experience in inspecting, investigating or enforcing laws, ordinances and/or rules and regulations, or a combination of both; and •one (1) year of supervisory experience. Qualifying Work Experience: The types of experience in which are deemed qualifying demonstrates knowledge of the principles and techniques of inspection and investigation; the ability to understand, interpret, and explain laws, rules, and regulations; the ability to gather, verify, and evaluate facts and evidence; and the ability to prepare reports. Examples of the kinds of experience which qualify are: 1.Experience in observing, receiving and otherwise obtaining information from all relevant sources; 2.Experience in using relevant information and judgement to determine whether events or process complies with a set of laws, rules, regulations or policies; 3.Experience in identifying underlying principles, reasons, or facts of information by breaking down information or data in to separate parts; 4.Experience in inspecting and examining something closely to identify the cause of error or problem; and 5.Experience in compiling information and writing concise reports on findings. PART II ASSISTANT CHIEF LIQUOR CONTROL INVESTIGATOR 2 15A2190 Non-Qualifying Work Experience: There are some types of experience which are related to investigative work but which are not acceptable, and applicants who possess only these kinds of experience will be disqualified. Experience is not acceptable if: (a) it did not demonstrate the application of investigation knowledge, abilities and skills described in the Training and Experience above; or (b) it was acquired in essentially clerical tasks or assignments. Examples of the kinds of experience which are not qualifying are: 1. Experience as a police officer performing duties such as patrolling an assigned area or beat, directing and controlling pedestrian and vehicular traffic, presenting talks and participating in panel discussions, promoting police-community relations, data processing, clerical work, promoting the Junior Police Officer Program and the Police Activities League, or other such non-investigative experience; 2. Experience as a guard, watchman, or private detective assigned principally to protect life and property, or such similar experience; 3. The investigation of minor insurance damage claims or the financial standing of individuals or firms for credit associations or for collection agencies; and 4. Experience as an inspector whose principal duties were to examine materials, plant and public facilities, equipment, animals, poultry, food, drugs, premises, insets, etc., to determine whether they conformed to prescribed specifications or standards. Qualifying Supervisory Work Experience: Professional work experience which include planning, directing, assigning and reviewing the work of others; advising subordinates on difficult program areas; timing and scheduling subordinate work; and training and developing new employees Substitutions Allowed: General professional work experience or education credits can be substituted for up to two (2) years of the Bachelor’s degree such as: A. Full time progressively responsible professional, technical or substantive work experience demonstrating the scope, level and quality of work comparable to a curriculum leading to an associate’s, bachelor's or master’s degree. B. Successful completion of semester credits in a curriculum leading to a degree or diploma at an accredited community college, trades school, college, or university. (15 semester credits = 6 months of experience). PART II ASSISTANT CHIEF LIQUOR CONTROL INVESTIGATOR 3 15A2190 Specialized professional work experience in public administration, business administration, criminal justice, law enforcement administration or a related field or education credits in public administration, business administration, criminal justice, law enforcement administration or a related field can be substituted for up to four (4) years of the Bachelor’s degree such as: A. Full time progressively responsible professional, technical or substantive work experience demonstrating the scope, level and quality of work comparable to a curriculum leading to an associate’s, bachelor's or master’s degree. B. Successful completion of semester credits specific to public administration, business administration, criminal justice, law enforcement administration or a related field or a related field leading to a degree or diploma from an accredited community college, trades school, college, or university (15 semester credits = 6 months of experience). A master’s degree or PhD in public administration, business administration, criminal justice, law enforcement administration or a related field may be substituted for the education requirement. The following may be substituted for experience: A. Successful completion of semester credits specific to public administration, business administration, criminal justice, law enforcement administration or a related field leading towards a Bachelor’s/Master’s/PhD degree from an accredited college or university, may be substituted up to one (1) year of the specialized work experience requirement. (15 semester credits = 6 months). B. A Master’s degree in public administration, business administration, criminal justice, law enforcement administration or a related field from an accredited college or university may be substituted for one (1) year of the specialized work experience requirement. C. A Doctorate’s degree in public administration, business administration, criminal justice, law enforcement administration or a related field from an accredited college or university may be substituted for one (1) year of the specialized work experience requirement. If a degree is used to substitute for the education requirement, it may not be used again towards the experience requirement. If work experience is used to substitute for education, it may not be used again to meet the experience requirement. If the applicant holds more than one degrees, transcripts must be provided and a thorough review will be conducted by the DHR staff in order for more than one degree to be credited towards the minimum qualification requirements. Additional degrees can be considered if obtained independently through mutually exclusive classes from another degree being considered. Substitutions will be used to the advantage of the applicant. PART II ASSISTANT CHIEF LIQUOR CONTROL INVESTIGATOR 4 15A2190 Quality of Experience: Possession of the required number of years of experience will not in itself be accepted as proof of qualification for a position. The applicant's overall experience must have been of such scope and level of responsibility as to conclusively demonstrate that he/she has the ability to perform the duties of the position for which he/she is being considered. License Requirement: Possession of the appropriate licenses or certificates as required of the position. Selective Certification: Specialized knowledge, skills and abilities may be required to perform the duties of some positions. For such positions, Selective Certification Requirements may be established and certification may be restricted to eligibles who possess the pertinent experience and/or training required to perform the duties of the position. Agencies requesting Selective Certification must show the connection between the kind of training and/or experience on which they wish to base selective certification and the duties of the position to be filled. Tests: Applicants may be required to qualify on an appropriate examination. Health and Physical Condition Requirements: Persons seeking appointment to positions in this class must meet the health and physical condition standards deemed necessary and proper to perform the essential functions of the position with or without reasonable accommodations. Physical Effort Grouping: Light This is an amendment to the specification for the class, ASSISTANT CHIEF LIQUOR CONTROL INVESTIGATOR, which was approved on October 19, 2021, and is to be substituted for that specification.
