HomeMy WebLinkAboutResolution No. 2022-02COUNTY COUNCIL COUNTY OF KAUA'! ~e5olutionNo. 2022-02 RESOLUTION DESIGNATING BLACK POT BEACH PARK, LYDGATE BEACH PARK, AND PO'IPU BEACH PARK AS MANAGED PARKING ZONES SUBJECT TO PARKING FEES WHEREAS, Kaua'i County Charter Section 4.02(J) provides that the County Council may adopt resolutions for the purpose of marking roads or regulating and adjusting the movement of traffic and pedestrians, and mandates that the regulation, mark, or adjustment sought to be effected is clearly indicated in the places where effective by legible markers or signs; and WHEREAS, Sections 16-2.l(b) and (d), Kaua'i County Code 1987, as amended, authorize the County Council to create, define, re-define, eliminate, or change no-parking zones and time-limit parking zones, and designate the type of markings or signs to be placed and maintained for the identification of those zones, and to determine and designate certain curb markings to indicate no parking or standing; and WHEREAS, pursuant to Section 19-1.20, Kaua'i County Code 1987, as amended, the Department of Parks and Recreation conducted a study of County parks to determine the extent of the depletion of resources due to overuse of the County parks, the degree of harm to County property resulting from overuse of the County parks, and the controls that may be necessary to address any current and future harm; and WHEREAS, Section 19-1.20, Kaua'i County Code 1987, as amended, authorizes the Department of Parks and Recreation to collect parking fees and impose penalties associated with managed parking at County parks, which based on the findings of the study, shall be used to protect the parks from future harm and depletion of resources; and WHEREAS, it was determined that the real property taxes paid by Kaua'i residents are used in part to fund the ongoing maintenance of the County's parks and parking lots, and therefore Kaua'i residents shall be exempt from County managed parking fees; and WHEREAS, the Department has completed the study and finds that additional maintenance and improvement at County parks is necessary to protect County resources and control overuse and degradation of the parks. The study confirms a need to collect a reasonable user fee to protect park resources and enable maintenance and improvements at County parks and parking facilities; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF KAUA'I, STATE OF HAWAI'I, THAT: SECTION 1. Black Pot Beach Park, Lydgate Beach Park, and Po'ipu Beach Park shall be subject to parking fees. SECTION 2. The Department of Parks and Recreation is authorized to mark as necessary all no-parking zones and time-limit parking zones in County parks, and to designate the type of markings or signs to be placed and maintained for the identification of those zones or areas, and to determine and designate certain curb markings to indicate no parking or standing. SECTION 3. This Resolution shall take effect upon its approval and the posting of the appropriate signs and/or markings. Introduced by: BERNARD P. CARVALHO, JR.
