Roll Call Director Rapozo called roll, noting 6 members were present. Approval of Agenda Mr. Gibson moved to approve the agenda. Mrs. Akita seconded the motion. Motion carried 6:0. Approval of Meeting Minutes APPROVAL OF MEETING MINUTES a) Open session minutes of October 3, 2019 b) Open session minutes of November 21, 2019 Mrs. Akita moved to approve the Open session minutes for October 3, 2019 and November 21, 2019. Mr. Pacheco seconded the motion. Motion carried 6:0. 1. Public Hearing KAUAI SEA TOURS (Imiola): Application No. 2020-067 was filed on December 10, 2019 by Na Pali Sea Tours dba Kauai Sea Tours for a New Tour or Cruise Vessel license at 4353 Waialo Road, ‘Ele’ele, Kauai, Hawaii. Deposited $100.00 Director Rapozo stated that Kauai Sea Tours did not require a Public Mailing, this will be an agenda item only, with a Public Hearing. Chair Endo asked if a copy of the report was received. Liquor Control Commission Open Session December 19, 2019 Page 2 Darren Paskal Vice President/General Manager on behalf of the applicant, stated he did not receive a copy of the report. Chair Endo asked, if he needed a few minutes to review the report. Mr. Paskal reviewed the investigators report. Chair Endo asked, if there were any comments regarding the report. Mr. Paskal stated, that he did not have any comments in regards to the report. Chair Endo asked, if there was any objections or anyone that would like to speak on behalf of the application. Hearing none Chair Endo closed the Public hearing for Na Pali Sea Tours. Mr. Matsunaga moved to approve Application 2020-067 Na Pali Sea Tours dba Kauai Sea Tours. Mr. Gibson seconded the motion. Motion carried 6:0. 2. Director’s Report DIRECTOR’S REPORTS: a) INVESTIGATORS’ REPORTS: b) INCOMING COMMUNICATIONS: 1) From Strike & Techel, Re: Fetzer Vineyards 1000 Stories Never the Same Story sweepstakes 2) Disturbance Reports from Grand Hyatt Kauai, Nāwiliwili Tavern, Sheraton Kauai Coconut Beach Resort, and Tahiti Nui c) OUTGOING COMMUNICATIONS: 1) To Remy Cointreau USA, Inc., Re: Remy Martin coupon offers 2) To All Wholesale Licensees, Re: Transfer Liquor License The Fish Express d) EMPLOYEES IN LICENSED PREMISES: Managers and Assistant Managers – See Attachment “A” Liquor Control Commission Open Session December 19, 2019 Page 3 e) ACTIONS OF THE DIRECTOR: 1) CHICKEN IN A BARREL: Approval of special request for temporary increase of premises to include the 60’ off the back lanai and onto the grass area on December 7, 2019 from 3:00 p.m. to 10:00 p.m.; and for temporary decrease of premises to exclude the back lanai and onto the grass area on December 11, 2019 from 3:00 p.m. to 10:00 p.m. 2) POIPU BEACH ATHLETIC CLUB: Approval of special request for permanent alteration of premises to add a 20’ x 40’ awning that will cover 5 additional tables, and will attach to the existing roof, per diagram submitted. 3) SAFEWAY LIHUE: Approval of special request to conduct tasting of 10 varieties of distilled spirits, per list, on December 20, 2019 from 4:00 p.m. to 6:00 p.m. 4) WAIMEA PLANTATION COTTAGES; Approval of special request for temporary decrease of premises to include the back lanai grass area behind Chicken In A Barrel on December 11, 2019 from 3:00 p.m. to 10:00 p.m. 5) THE WINE SHOP: Approval of special request to conduct tasting of 4 varieties of wine, per list, on December 7, 2019 from 2:00 p.m. to 8:00 p.m. f) INFORMATIONAL MATTERS Mr. Pacheco moved to approve Items 3(a) through f. Mr. Matsunaga seconded the motion. Motion carried 6:0. 3. TRANSFER OF LIQUOR LICENSE WITHIN 1-YEAR: STOR BOX LLC: StorR Box LLC requests permission to transfer Retail Dealer General License No. 4G-045 which was issued on August 15, 2019 within 1-year of issuance. Mrs. Akita moved to approve transfer of liquor license within 1-year. Mr. Matsunaga seconded the motion. Motion carried 6:0. 4. TRANSFER LIQUOR LICENSE: Liquor Control Commission Open Session December 19, 2019 Page 4 MAUKA SUSHI: Application No. 2020-041 was filed on December 5, 2019 for a transfer of Retail Dealer General License No. 4G-045 from stoR Box LLC dba stoR Box LLC to Yanagi Sushi Kauai LLC dba Mauka Sushi located at 1824 Haleukana St. Bldg. 2, Unit 1, Līhu‘e, Kauai, Hawaii. Deposited $250. Commission accepted the application for publication and public hearing from stoR Box LLC to Yanagi Sushi Kauai LLC. Mrs. Akita moved to accept the application for publication and public hearing liquor license from stoR Box LLC to Yanagi Sushi Kauai LLC. Mrs. Kusaka seconded the motion. Motion carried 6:0 5. CANCELLATION OF LIQUOR LICENSE: KAUAI PASTA CORPORATION: Cancellation of Restaurant General License No. 2G-060 issued to Kauai Pasta Corporation dba Kauai Pasta. Mr. Matsunaga moved that the Liquor License of Kauai Pasta Corporation be cancelled. Mrs. Akita seconded the motion. Motion carried 6:0 6. PERMANENT INCREASE OF PREMISES: KAUAI ISLAND BREWING COMPANY: Request for permanent increase of premises to include 15’ by 50’ open deck area being constructed at the back of the establishment. Mr. Matsunaga moved to approve the permanent increase of premises for Kauai Island Brewing Company. Mrs. Akita seconded the motion. Motion carried 6:0 7. DISCUSSION AND POSSIBLE DECISION MAKING ON DIRECTOR OF LIQUOR CONTROL JOB DESCRIPTION Ellen Ching, Boards and Commissions Administrator, requested this item be deferred. Mr. Gibson moved to defer the Director of Liquor Control job description to January 2, 2020. Mr. Pacheco seconded the motion.
