Announcements Next Scheduled Meeting: Thursday, December 3, 2020 – 10:00 a.m. via Tele-Conference. Approval of Agenda Mr. Pacheco moved to approve the agenda. Mr. Matsunaga seconded the motion. Motion carried 7:0. Approval of Meeting Minutes APPROVAL OF MEETING MINUTES: A. Open Session Minutes of October 1,2020 Mr. Pacheco moved to approve Open Session Minutes of October 1, 2020. Mr. Matsunaga seconded the motion. Motion carried 7:0. Liquor Control Commission Open Session December 03, 2020 Page 2 SUBJECT DISCUSSION ACTION Public Testimony None 1. DIRECTOR’S REPORTS: a) INVESTIGATORS’ REPORTS: b) ACTIONS OF THE DIRECTOR: c) INFORMATIONAL MATTER Motion#1 Mr. Gibson moved to approve Director’s Reports 1a through c. Mr. Pacheco seconded the motion. Motion rescinded by Mr. Gibson and the seconded was rescinded by Mr. Pacheco. Motion #2 Mr. Gibson moved to approve Director’s Report 1a and b Mr. Pacheco seconded the motion. Motion carried 7:0. 2. VIOLATION REPORT: A. HEALTHGO MARKET INC.: Violation of Rule 10.2 Manager on duty, qualifications. Mr. Nishimura moved to receive the Violation Report, and set up a Violation Hearing. Mr. Pacheco seconded the motion. NEW LIQUOR LICENSE: WAINIHA COUNTRY MARKET dba WAINIHA COUNTRY MARKET: Application No. 2021-012 was filed on October 7, 2020 by WAINIHA COUNTRY MARKET dba WAINIHA COUNTRY MARKET for a New Class and Kind (Retail Dealer Beer & Wine) at the former Wainiha General Store, located at the intersection of Kuhio Highway and Ananalu Road in Wainiha. The address is 5-607 Kuhio Highway, Wainiha, Kauai, Hawaii. Deposited $450 Commissioner Nishimura stated on the 5th paragraph of the Investigators Report is listed as 17,860 square feet single story wooden structure, requests for correct information. Investigator Herman stated it should be 1,700, will double check with Investigator Stem. Commissioner Nishimura asked are there any notification requirements, he is concerned of the remote location and a house next door. Investigator Herman replied yes, they are bound to mail out a notification to everyone within a 500 feet radius. Mr. Nishimura moved to receive the Application No. 2021-012 for WAINIHA COUNTRY MARKET dba WAINIHA COUNTRY MARKET and schedule for Publication and Public Hearing. Mr. Pacheco seconded the motion. Motion carried 7:0. Liquor Control Commission Open Session December 03, 2020 Page 4 SUBJECT DISCUSSION ACTION 4. UPDATE ON APPLICANTS FOR THE DIRECTOR OF LIQUOR CONTROL (November 5, 2020, November 19, 2020) Ellen Ching, Administrator for Boards and Commission reported the application period closed on November 30, 2020. In discussion with the Human Resource Department they have received 16 applicants. Resumes will be provided to the PIG (Permitted Interaction Group) they will be screening those resumes and providing the Commission with a report. Chair Akita asked if there were any questions. Commissioner Nishimura stated for the benefit of the entire Commission, for the first cut the PIG (Permitted Interaction Group) will go through the Applications that were handed in, and check to see who will not be receiving written inquires. This is the first of the three part application/screening process. Chair Akita asked, is this to screen out the minimal qualifications. Commissioner Nishimura replied yes. No motion needed to accept report. 5. STATUS REPORT ON THE INTERVIEW QUESTIONS AND SCORING SHEET FROM THE PIG (PERMITTED INTERACTION GROUP) FOR THE NEW DIRECTOR OF LIQUOR CONTROL (November 5, 2020, November 19, 2020) Ellen Ching, Administrator for Boards and Commission reported that the PIG (Permitted Interaction Group) met yesterday December 2, 2020 and there are some revisions. The PIG (Permitted Interaction Group) is still working on this part of the process. Upon completion they will present a report to the Commission. Information only, no motion needed. Mr. Matsunaga moved to adjourn the Meeting. Mr. Pacheco seconded the motion. Motion Carried 7:0 At 10:19 a.m. the meeting was adjourned.
