Yoshioka (808) 241-4800 PROSECUTING ATTORNEY SPECIAL ELECTION CLARIFICATION Līhu‘e, Kaua‘i – In response to numerous inquiries concerning the dates of the upcoming Prosecuting Attorney Special Elections, the Office of the County Clerk wishes to inform the public that while Section 9A.05 (b) of the Kaua‘i County Charter states that a special primar y election will be held within forty-five after the occurrence of the vacancy and a special general election will be held thirty days after the special primary election, this timeline conflicts with Hawai‘i Revised Statutes Section 15D-9 (a), which requires that ballots and balloting materials be transmitted no later than forty-five days before the election. Given the conflicting dates, State law in Section 15D-9 (a) supersedes requirements of the County Charter and shall dictate when the special elections will occur. Additional dates, deadlines, and information for the special elections will be contained in the official Proclamation that will be published soon after the Prosecuting Attorney vacates office. ###
