HomeMy WebLinkAbout1.541 PROCESS SERVER 20220707PART I DEPARTMENT OF HUMAN RESOURCES COUNTY OF KAUAI 1.541 Class Specifications for the Class: PROCESS SERVER SR-15, BU-03 Duties Summary: Responsible for serving civil and/or criminal process documents such as court orders, summonses, subpoenas, notices and providing proof of service throughout the County to witnesses; independently researches, investigates and determines the location of defendants or witnesses, by using public records and/or private law enforcement database information; sets and prioritizes daily schedule and provides technical support to the department; and performs other related duties as required. Distinguishing Characteristics: This class is distinguished by its responsibility to serve civil and/or criminal process documents and providing proof of service throughout the County of Kaua‘i, requiring the operation of a motor vehicle; and independently researches, investigates and determines the location of defendants or witnesses using public records and/or private law enforcement database information. When serving documents, situations may occur causing deviation from established procedures and these positions are expected to use judgment and discretion to make sound decisions. The Process Server may need to do extensive studies to determine the physical resemblance of the person they're serving and the best way to ensure personal delivery of documents and notifications. Extensive time spent in the research process on computers in an office environment to determine identity of persons to be served is required. A position in this class requires considerable knowledge of applicable court rules and/or statutes concerning the service of process in criminal and/or civil matters in the Hawai‘i State Courts. In addition, the Process Server provides services such as research, complex sorting and filing and responsible technical support to the Special Investigators. Examples of Duties: (The following are examples of duties and are not necessarily descriptive of any one position in this class. The omission of specific duties statements does not preclude management from assigning such duties if such duties are a logical assignment for the position). • Receives legal process documents and written instructions for service of documents to litigants; PART I PROCESS SERVER 2 1.541 • Reviews all documents for accuracy, completeness, and in compliance with applicable court rules and/or statutes prior to service; • Operates a motor vehicle to serve civil and/or criminal process including subpoenas, summonses, and notices; • Locates witnesses and makes positive identification of person being served; • Plans daily workload and route to facilitate the service process with minimum travel; • Informs person(s) served of the general contents of the documents being served; • Conducts jail visits to perform initial defense advisements to persons charged with criminal charges; • Contacts employers, families, neighbors, and others to secure information regarding the whereabouts of individuals in order to affect the service process; • Provides services such as research, complex sorting and filing and responsible technical support to the Special Investigators, which may include assisting with lower- end investigations and interviews in locating and identifying persons to be served; • Prepares reports on documents served or attempted; • Signs proof of service documents and maintains records and logs; • Tracks time and date of service delivery; • Maintains and updates computerized and manual files; • Performs a variety of difficult clerical or routine administrative work; • May testify in court regarding the measures taken (due diligence) to locate witness(es); and • Performs other related duties as assigned. Knowledge of: Principles and practices of public contact; documentation and recordkeeping methods; geography of the County of Kaua‘i; applicable court rules and/or statutes concerning service of process in criminal and civil matters in the Hawai‘i State Courts; office practice procedures; filing methods and systems; use of standard office machines. PART I PROCESS SERVER 3 1.541 Ability to: Plan and organize daily workload; learn the procedure for the service of different types of legal documents; maintain simple recordkeeping systems; communicate effectively with people; maintain confidentiality of information; read maps and locate addresses; establish and maintain cooperative working relationships; determine the appropriate course of action in emergency or unusual situations; understand written and oral instructions. This is an amendment to the specification for the class PROCESS SERVER, which was approved on July 5, 2016, and is to be substituted for that specification. Approved: July 7, 2022 (date) ANNETTE L. ANDERSON Director of Human Resources PART II DEPARTMENT OF HUMAN RESOURCES COUNTY OF KAUAI 1.541 Minimum Qualification Specifications for the Class: PROCESS SERVER SR-15; BU-03 Training and Experience: A combination of education and experience substantially equivalent to graduation from high school; and • Three (3) year of work experience which involved reviewing or explaining legal or other comparable documents or information. Examples of legal documents: A legal document is considered legal if the creator intends for it to be enforceable in a court of law, it adheres to the laws of the jurisdiction where it will be enforced, and if the document is properly signed, witnessed, and filed. Substitutions Allowed: The following may be substituted for education: A. Four (4) years of full-time general work experience may be substituted for a high school diploma. B. Successful completion of semester credits leading towards a degree or diploma from an accredited community college, college or university, trades school, etc., may be substituted up to four (4) years of the education requirement (15 semester credits = 6 months). C. An Associate’s, Bachelor’s, Master’s or PhD degree from an accredited community college, college or university, trades school, etc., may be substituted for the education requirement. The following may be substituted for experience: A. Successful completion of semester credits leading towards a degree or diploma in legal secretary studies, paralegal studies, legal studies, law, or a related field from an accredited community college, trades school, may be substituted up to four (4) years of work experience which involved reviewing or explaining legal or other comparable documents or information (15 semester credits = 6 months). PART II PROCESS SERVER 2 1.541 B. An Associate’s degree in legal secretary studies, paralegal studies, legal studies, law, or related field from an accredited community college, business, or technical school, may be substituted for two (2) years of work experience which involved reviewing or explaining legal or other comparable documents or information. C. A Bachelor’s degree in legal secretary studies, paralegal studies, legal studies, law, or a related field from an accredited college or university may be substituted for up four (4) years of work experience which involved reviewing or explaining legal or other comparable documents or information. D. A Master’s or PhD degree in legal secretary studies, paralegal studies, legal studies, law, or a related field from an accredited college or university may be substituted for up to one (1) year of work experience which involved reviewing or explaining legal or other comparable documents or information. If a degree is used to substitute for the education requirement, it may not be used again towards the experience requirement. If work experience is used to substitute for education, it may not be used again to meet the experience requirement. If the applicant holds more than one degree, transcripts must be provided, and a thorough review will be conducted by the DHR staff in order for more than one degree to be credited towards the minimum qualification requirements. Additional degrees can be considered if obtained independently through mutually exclusive classes from another degree being considered. Substitutions will be used to the advantage of the applicant. Quality of Experience: Possession of the required number of years of experience will not in itself be accepted as proof of qualification for a position. The applicant's overall experience must have been of such scope and level of responsibility as to conclusively demonstrate that he/she has the ability to perform the duties of the position for which he/she is being considered. License Requirement: Possession of a valid motor vehicle operator's license (Hawaii type 3 or equivalent), and any other appropriate licenses or certificates as required of the position. Selective Certification: Specialized knowledge, skills and abilities may be required to perform the duties of some positions. For such positions, Selective Certification Requirements may be established, and certification may be restricted to eligibles who possess the pertinent experience and/or training required to perform the duties of the position. Agencies requesting Selective Certification must show the connection between the kind of training and/or experience on which they wish to base selective certification and the duties of the position to be filled. PART II PROCESS SERVER 3 1.541 Tests: Applicants may be required to qualify on an appropriate examination. Health and Physical Condition Requirements: Persons seeking appointment to positions in this class must meet the health and physical condition standards deemed necessary and proper to perform the essential functions of the position with or without reasonable accommodations. Physical Effort Grouping: Light This is an amendment to the specification for the class PROCESS SERVER, which was approved on July 5, 2016, and is to be substituted for that specification.
