JULY 26, 2017
A public hearing of the Council of the County of Kaua`i was called to order by
Arryl Kaneshiro, Chair, Budget & Finance Committee, on Wednesday, July 26, 2017,
at 1:35 p.m., at the Council Chambers, 4396 Rice Street, Suite 201, Historic County
Building, Lihu`e, and the presence of the following was noted:
Honorable Arthur Brun
Honorable Mason K. Chock (present at 1:37 p.m.)
Honorable Ross Kagawa
Honorable Arryl Kaneshiro
Honorable Mel Rapozo
Not Present: Honorable Derek S.K. Kawakami
Honorable JoAnn A. Yukimura
The Clerk read the notice of the public hearing on the following:
"Bill No. 2658 — A BILL FOR AN ORDINANCE AMENDING
CHAPTER 5A, ARTICLE 11 AND 11A, KAUAI COUNTY CODE 1987, AS
AMENDED, RELATING TO REAL PROPERTY TAX,"
which was ordered to print by the Council of the County of Kaua`i on June 28, 2017,
and published in The Garden Island newspaper on July 5, 2017.
The following communication was received for the record:

The hearing proceeded as follows:
SCOTT K. SATO, Deputy County Clerk: We have one (1)
registered speaker and have one (1) written testimony in support. The first speaker
is Cynthia Hannah-White.
Committee Chair Kaneshiro: Cynthia, just come on up. There is a button.
You can sit down.
CYNTHIA HANNAH-WHITE: I am not going to be here that long.
Committee Chair Kaneshiro: Okay. There is a button right here, to push,
and then just state your name for the record. The light is going to go on. It is going
to turn green and you have three (3) minutes. It will turn yellow when you have
thirty (30) seconds, and red when your time is done. There is another three (3)
minutes if you need.
Ms. Hannah-White: Thank you. My name is Cynthia
Hannah-White. I am here on behalf of myself and the clients of my law firm, Kaua`i
Estate Law, LLC. I submitted written testimony. I am happy to answer any
questions that anyone has about my written testimony or to clarify anything if anyone
needs clarification.

Committee Chair Kaneshiro: Thank you.
Ms. Hannah-White: I support the Bill for the reasons stated in my
written testimony. A lot of people transfer their property into and out of a trust for
estate planning purposes. I think that the purpose of the three percent (3%) cap
would be best served if these transfers, which are not actually changes of beneficial
ownership, are exempted from the transfer requirement.
Committee Chair Kaneshiro: Okay. Thank you. We did receive your
written testimony, so thank you.
Ms. Hannah-White: Okay. Thank you.
Committee Chair Kaneshiro: Is there anyone else, Scott? Anyone else in
the audience wishing to testify on this? Seeing none, this public hearing is now
adjourned.
There being no further testimony, the public hearing adjourned at 1:37 p.m.
