Yukimura, Chair, Public Safety & Transportation Committee, on Wednesday, December 6, 2017, at 1:35 p.m., at the Council Chambers, 4396 Rice Street, Suite 201, Historic County Building, Lihu`e, and the presence of the following was noted: Honorable Mason K. Chock Honorable Arryl Kaneshiro Honorable Derek S.K. Kawakami (present at 1:38 p.m.) Honorable Mel Rapozo Honorable JoAnn A. Yukimura Not Present: Honorable Arthur Brun Honorable Ross Kagawa The Clerk read the notice of the public hearing on the following: "Bill No. 2673 — A BILL FOR AN ORDINANCE AMENDING CHAPTER 16, KAUAI COUNTY CODE 1987, RELATING TO THE TRAFFIC CODE (Prohibited Parking)," which was ordered to print by the Council of the County of Kaua`i on November 1, 2017, and published in The Garden Island newspaper on November 8, 2017. SCOTT K. SATO, Deputy County Clerk: We received no written testimony and we have one (1) registered speaker. The first speaker is Roger A. Ridgley. Committee Chair Yukimura: I should have noted that there is a quorum here today. Mr. Ridgley. ROGER A. RIDGLEY: My name is Roger Ridgley. My company's name is called "A Tow In Paradise" and I am here just to ask a few questions. I saw this in the newspaper about the towing. Is this going to go into effect soon, is it going out for a contact? If it goes out for a contract, are they going to inspect the vehicles, which they are not doing right now?Are they going to cover the insurance, which you have to have, which will be on-hook liability and the thing for the interior that is called...it is to insure the contents of the car? For example, if you tow an illegally parked car and the customer says there were something in the car, you had to have the insurance to cover that. This is the first time this has happened on Kaua`i, and number one, I can see why you folks are in the process of doing this, but Kaua`i is very slow when it comes to towing procedures. I think the liability that is going to come upon the County, unless this is done properly, you are going to have a lot of problems. Committee Chair Yukimura: Mr. Ridgley, this law does not affect towing policy or anything like that. It mainly determines how the police can determine PUBLIC HEARING 2 DECEMBER 6, 2017 BILL NO. 2673 whether there is a parking violation and tries to prevent cars from being so much overlapping into the road that they actually block traffic or cause an oncoming car to move into another lane. Mr. Ridgley: So this has nothing to do with cars being parked in a no-parking zone? Committee Chair Yukimura: Well, it will determine where some no- parking will be, but it does not determine anything about the towing process. Mr. Ridgley: But in the next one, it says... Council Chair Rapozo: You might be here for the next public hearing. Mr. Ridgley: Oh, I have to wait for the next one? Council Chair Rapozo: Yes. This public hearing is for parking. The next public hearing will be after you are done. Committee Chair Yukimura: Thank you. I did not realize that. Mr. Ridgley: I thought it was all together as one. Committee Chair Yukimura: It looks like that, but we are actually taking them one after the other. Sorry that I did not...thank you, Chair. Mr. Ridgley: That is okay. Committee Chair Yukimura: Why do you not step back and then we will read the notice of the next item and I think that is when you want to speak on. Mr. Ridgley: Thank you. (Councilmember Kawakami was noted as present.) Committee Chair Yukimura: Are there further testimony? If not, is there are no one who wishes to speak, then public hearing is adjourned.
