APRIL 11, 2018
A public hearing of the Council of the County of Kaua`i was called to order by
Arthur Brun, Vice Chair, Public Safety & Transportation Committee, on Wednesday,
April 11, 2018, at 1:40 p.m., at the Council Chambers, 4396 Rice Street, Suite 201,
Historic County Building, Lihu`e, and the presence of the following was noted:
Honorable Arthur Brun
Honorable Mason K. Chock
Honorable Arryl Kaneshiro
Honorable Derek S.K. Kawakami
Honorable Ross Kagawa
Honorable Mel Rapozo
Excused: Honorable JoAnn A. Yukimura
The Clerk read the notice of the public hearing on the following:
"Bill No. 2695 — A BILL FOR AN ORDINANCE AMENDING
CHAPTER 19 AND ESTABLISHING A NEW ARTICLE 26, CHAPTER 22,
KAUAI COUNTY CODE 1987, AS AMENDED, RELATING TO WHIPS AND
WEAPONS ON COUNTY PROPERTY,"
which was ordered to print by the Council of the County of Kaua`i on
March 15, 2018, and published in The Garden Island newspaper on March 22, 2018.
The hearing proceeded as follows:
JADE K. FOUNTAIN-TANIGAWA, County Clerk: Committee Vice Chair, we
have one (1) registered speaker, Ed Justus.
ED JUSTUS: Good afternoon, Council. Ed Justus, for the
record. I am a Hanapepe resident. Thank you for having this as an item to actually
be discussed and having a public hearing on it. I can tell you that Hanapepe
appreciates it immensely. We have been dealing with guys cracking the bull whip for
three (3) years now. It is not like they are doing it just during the day, it is happening
six o'clock on the morning, eleven o'clock in the afternoon. Then they go into nine-
thirty at night, three o'clock in the morning. This is just unacceptable. The thing
that could really help all of us is that instead of it just being for County property, the
issue is also it happening in neighborhoods and commercial areas. There have been
times where these guys walk down the street during Friday night in Hanapepe
cracking their bull whips and there is a lot of people around. It is not safe. It is scary.
They also do it by the Hanapepe Swinging Bridge. You folks have heard it, I assume.
There used to be guys out here cracking them. It is frightening and it sounds like a
gun shot. We would love for you folks to solve this problem. One possible solution

would be if you include residential and commercial areas to have a certain distance,
like they can crack their whips, but it has to be within "x amount" of feet or whatever,
maybe one (1) mile or something from residences. We would love to see you folks
solve this problem. That is it. Thank you. If you need any videos of them, I have
that, too. Thank you.
Committee Vice Chair Brun: Thank you. Is there anyone else in the
audience wanting to testify on this matter? Councilmember Yukimura had some
personal stuff to take care of, so she sends her apologies. She will be reviewing the
video tapes on this public hearing. This public hearing is now adjourned.
There being no further testimony, the public hearing adjourned at 1:44 p.m.
