HomeMy WebLinkAbout02/05/2020 Public hearing minutes on BILL 2769 PUBLIC HEARING FEBRUARY 5, 2020 A public hearing of the Council of the County of Kaua`i was called to order by Felicia Cowden, Chair, Public Safety & Human Services Committee, on Wednesday, February 5, 2020, at 1:47 p.m., at the Council Chambers, 4396 Rice Street, Suite 201, Historic County Building, Lihu`e, and the presence of the following was noted: Honorable Arthur Brun Honorable Mason K. Evslin Honorable Ross Kagawa The Clerk read the notice of the public hearing on the following: "Bill No. 2769 — A BILL FOR AN ORDINANCE AMENDING CHAPTER 15A, KAUAI COUNTY CODE 1987, AS AMENDED, RELATING TO THE KAUAI COUNTY FIRE CODE," which was ordered to print by the Council of the County of Kaua`i on January 16, 2020, and published in The Garden Island newspaper on January 21, 2020. The following communications were received for the record: 1. Contractors Association of Kaua`i, dated February 5, 2020 2. Esaki, Dennis, dated February 5, 2020 3. Harris, Jeremy, dated February 5, 2020 4. Lau, Laurence, E-mail received on February 4, 2020 The hearing proceeded as follows: SCOTT K. SATO, Deputy County Clerk: We received four (4) written testimonies and we have three (3) registered speakers that signed up for both Bills Nos. 2768 and 2769. Committee Chair Cowden: Do we have anyone who would like to testify? Jeremy? JEREMY HARRIS: Chairman, members of the Council, my name is Jeremy Harris and I am here as the President of the Nawiliwili Estates Association of Apartment Owners (AOAO). I want to start by thanking you for addressing this issue. It is important to a lot of people around the island, especially the people here PUBLIC HEARING 2 FEBRUARY 5, 2020 BILL NO. 2768 in the Nawiliwili area. I just want to reiterate my testimony from the first reading, which was to point out the discrepancy between Section 18.2.3.2.1 and Section 18.2.3.4.4. The first, I believe correctly, basically says, "The fire truck has to get within three hundred (300) feet of the structure." The second says, "The fire truck has to be able to turnaround within one hundred fifty (150) feet of the structure. I understand there may be an amendment in process to correct that. We would certainly support language that says, "The fire truck has to be able to turnaround within one hundred fifty (150) feet of the end of the road. I think that is what they were going after when they drafted this in the first place. With that, I want to thank you again. I would be happy to answer any questions. Committee Chair Cowden: Do we have any other speakers. MAKA`ALA KA`AUMOANA: Maka'ala Ka'aumoana. I would just like to stand on my previous testimony as applying to both Bills. Committee Chair Cowden: Okay. Larry? LAURENCE LAU: Larry Lau. I stand on my previous testimony. I would like to add that I personally wrote to the heads of the Hanalei-Ha'ena Community Association, the Kilauea Neighborhood Association, and the Wailua-Kapa'a Neighborhood Association about this issue. Committee Chair Cowden: Fred, did you want to testify? Okay. If there is no further testimony, this will be coming up on an upcoming agenda. We appreciate all that you have to say.
