APRIL 22, 2020
A public hearing of the Council of the County of Kauai was called to order by
Mason K. Chock, Chair, Planning Committee, on Wednesday, April 22, 2020, at
8:53 a.m., at the Council Chambers, 4396 Rice Street, Suite 201, Historic County
Building, Lihu`e, and the presence of the following was noted:

Honorable Felicia Cowden
Honorable Luke A. Evslin (via remote technology)
Honorable Ross Kagawa
Honorable KipuKai Kuali`i
Honorable Arryl Kaneshiro
Excused: Honorable Arthur Brun*
JADE K. FOUNTAIN-TANIGAWA, County Clerk: Please note that
today's public hearings will be called to order pursuant to the Governor's
Supplementary Emergency Proclamation dated March 16, 2020.
The Clerk read the notice of the public hearing on the following:
"Bill No. 2781 — A BILL FOR AN ORDINANCE TO AMEND
CHAPTER 8, KAUA`I COUNTY CODE 1987, AS AMENDED, RELATING TO
THE COMMERCIAL ZONING DISTRICT OF THE COMPREHENSIVE
ZONING ORDINANCE TO IMPLEMENT THE 2018 GENERAL PLAN
UPDATE (County of Kauai Planning Department, Applicant) (ZA-2020-6),"
which was ordered to print by the Council of the County of Kauai on
March 25, 2020, and published in The Garden Island newspaper on April 2, 2020.
The following communication was received for the record:

The hearing proceeded as follows:
Committee Chair Chock: Do we have or have we received testimony on
this? I thought we had a few. Was it for or against?
Ms. Fountain-Tanigawa: We just received one (1) written testimony.

Committee Chair Chock: That was neither in support nor against, is
that correct?
Ms. Fountain-Tanigawa: Correct.
Committee Chair Chock: That is all the testimony that we have.
There being no further testimony, the public hearing adjourned at 8:55 a.m.

*Beginning with the March 11, 2020 Council Meeting and until further notice,
Councilmember Arthur Brun will not be present due to U.S. v. Arthur Brun et al.,
Cr. No. 20-00024-DKW (United States District Court), and therefore will be noted as
excused (i.e., not present).
