A BILL FOR AN ORDINANCE ESTABLISHING CHAPTER 5, ARTICLE 4,
KAUAI COUNTY CODE 1987, AS AMENDED, IMPLEMENTING A
COUNTY TRANSIENT ACCOMMODATIONS TAX
The purpose of this Bill is to amend Chapter 5, Kaua`i County Code 1987, as
amended, by establishing a new Article 4 implementing a County Transient
Accommodations Tax, pursuant to Act 1, Special Session Laws of Hawai`i 2021.
Bill No. 2829 would establish a three percent (3%) County Transient
Accommodations Tax on all gross rental, gross rental proceeds, and fair market
rental value considered taxable under the definitions of Section 237D-1, Hawai`i
Revised Statutes. The County Transient Accommodations Tax shall be levied,
assessed, and collected each month on the gross rental or gross rental proceeds
derived from furnishing transient accommodations. All operators, plan managers,
transient accommodations brokers, travel agencies, and tour packagers within the
County must hold a State certificate of registration pursuant to Sections 237D-4
and 237D-4.5, Hawai`i Revised Statutes, and on or before the twentieth day of each
calendar month, shall file with the County Finance Director a sworn return
together with remittance for the amount of tax due.
Bill No. 2829 would also authorize the County Finance Director to enter into
an agreement with the State for collection of the County Transient Accommodations
Tax, and to promulgate rules to implement the purposes of the County Transient
Accommodations Tax.
All interested persons who wish to present their comments may do so at the
public hearing. Written testimony prior to the hearing would be appreciated.
Written testimony can be submitted to the Office of the County Clerk, Council
Services Division by mail, facsimile, or via E-mail to counciltestimony@kauai.gov.
Copies of the Bill are available at the Office of the County Clerk, Council Services
Division.
(The Council Committee or Council may amend this Bill at their subsequent
meetings. Meeting notices are posted at least six (6) days in advance at the County
Clerk's Office and the public may also testify at any of these meetings.)
