NOTICE OF PUBLICATION AND NOTICE OF PUBLIC HEARING
P # Notice is hereby given that the Council of the County of Kaua`i will hold a
public hearing on Wednesday, November 15, 2017, at 1:30 p.m., or soon thereafter,
at the Council Chambers, 4396 Rice Street, Room 201, Historic County Building,
Lihu`e, on the following:
Bill No. 2670
A BILL FOR AN ORDINANCE TO ESTABLISH A GENERAL EXCISE AND
USE TAX SURCHARGE FOR THE COUNTY OF KAUAI
This Bill proposes to establish a new Article 3, Chapter 5, Kaua`i County
Code 1987, as amended, relating to a General Excise and Use Tax Surcharge for the
County of Kaua`i, pursuant to Act 001, Session Laws of Hawai`i, Special Session
of 2017.
This Bill establishes a one-half percent (0.5%) general excise and use tax
surcharge to be levied beginning January 1, 2019, for the following purposes:
1. Operating or capital costs of public transportation within the County of
Kaua`i for public transportation systems as allowed by law.
2. Expenses in complying with the Americans with Disabilities Act of 1990
as allowed by law.
"Capital costs" is defined as nonrecurring costs required to construct a transit
facility or system, including debt service, costs of land acquisition and development,
acquiring of rights-of-way, planning, design, and construction, and including
equipping and furnishing the facility or system.
The Director of Finance is authorized to establish and create a "G.E. Tax
Fund" for deposit of moneys derived from this surcharge. Any balance remaining in
the G.E. Tax Fund shall not lapse, and shall accumulate from year to year.
No surcharge on state taxes may be levied under this Ordinance after
December 31, 2030.
All interested persons who wish to present their comments may do so at the
public hearing. Written testimony prior to the hearing would be appreciated.
Written testimony can be submitted to the Office of the County Clerk, Council
Services Division by mail, facsimile, or via E-mail to counciltestimony @kauai.gov.
Copies of the Bill are available at the Office of the County Clerk, Council Services
Division.
(The Council Committee or Council may amend this Bill at its subsequent
meetings. Meeting notices are posted at least six (6) days in advance at the County
Clerk's Office and the public may also testify at any of these meetings.)
