COMMITTEE OF THE WHOLE
December 13, 2017
A meeting of the Committee of the Whole of the Council of the County of Kaua`i,
State of Hawai`i, was called to order by Mel Rapozo, Chair, at the Council Chambers,
4396 Rice Street, Suite 201, Lihu`e, Kaua`i, on Wednesday, December 13, 2017, at
11:08 a.m., after which the following Members answered the call of the roll:
Honorable Arthur Brun
Honorable Mason K. Chock
Honorable Ross Kagawa
Honorable Arryl Kaneshiro
Honorable Derek S.K. Kawakami
Honorable JoAnn A. Yukimura
Honorable Mel Rapozo
EXECUTIVE SESSION:
ES-933 Pursuant to Hawai`i Revised Statutes (HRS) Sections 92-4,
92-5(a)(2), 92-5(a)(4), and Kaua`i County Charter Section 3.07(E), the Office of the
County Attorney, on behalf of the Kaua`i County Council, requests an Executive
Session to brief the Committee of the Whole on matters regarding the damaged
County of Kaua`i's sewer transmission line along KLlhio Highway within the
Hanamd'ulu—Kapaia sewer system, and related matters. This briefing and
consultation involves consideration of the powers, duties, privileges, immunities,
and/or liabilities of the Council and the County as they relate to this agenda item.
Councilmember Kagawa moved to convene in Executive Session for
ES-933, seconded by Councilmember Kaneshiro.
Council Chair Rapozo: Is there any discussion? Is there any public
testimony?
There being no objections, the rules were suspended to take public testimony.
There being no one present to provide public testimony, the meeting was called
back to order, and proceeded as follows:
Council Chair Rapozo: Before we take the roll call, for the audience,
around 11:30 a.m., we will be back here and it would give us one (1) hour for public
testimony for today's Special Planning Committee Meeting. So we will give ourselves
twenty (20) minutes in the back in Executive Session.
Councilmember Yukimura: So back at 11:30 a.m.?
Council Chair Rapozo: Yes. I do not even know what this is about.
We may be right back out in open session if I do not believe it meets the criteria for
Executive Session. With that, roll call.

The motion to convene in Executive Session for ES-933 was then put, and
carried by the following vote:
FOR EXECUTIVE SESSION: Brun, Chock, Kagawa, Kaneshiro,
Kawakami, Yukimura, Rapozo TOTAL — 7,
AGAINST EXECUTIVE SESSION: None TOTAL— 0,
EXCUSED & NOT VOTING: None TOTAL— 0,
RECUSED & NOT VOTING: None TOTAL — 0.
Councilmember Yukimura: Chair?
Council Chair Rapozo: Yes?
Councilmember Yukimura: If we come back sooner, you want people to
sort of hang around?
Council Chair Rapozo: Yes, they just have to wait outside. As soon
as we are done with Executive Session, we will call them in.
Councilmember Yukimura: Okay. Thank you.
Council Chair Rapozo: Thank you.
There being no objections, the meeting recessed at 11:11 a.m.
The meeting reconvened at 11:32 a.m., and proceeded as follows:
(Council Chair Rapozo was noted as not present.)
Council Vice Chair Kagawa: Seeing that we are done with Executive
Session, the Committee of the Whole is adjourned.
There being no further business, the meeting was adjourned at 11:32 a.m.
