MAY 27, 2020
The Special Council Meeting of the Council of the County of Kaua`i was called
to order by Council Chair Arryl Kaneshiro at the Council Chambers, 4396 Rice Street,
Suite 201, Lihu`e, Kaua`i, on Wednesday, May 27, 2020 at 8.40 a.m., after which the
following Members answered the call of the roll.

Council Chair Kaneshiro Please note that we will run today's meeting
pursuant to the Governor's Supplementary Emergency Proclamation dated
March 16, 2020, Sixth Supplementary Emergency Proclamation dated April 25, 2020,
and Seventh Supplementary Emergency Proclamation dated May 5, 2020
APPROVAL OF AGENDA
Council Chair Kaneshiro• The first item is the approval of the agenda
Councilmember Kuali`i moved for approval of the agenda, as circulated,
seconded by Councilmember Chock
(No written testimony was received and no registered speakers requested to
testify regarding this agenda item)
Council Chair Kaneshiro. Any discussion on the agenda from the
members?
The motion for approval of the agenda, as circulated, was then put, and carried
by a vote of 6 0 1*.

LEGAL DOCUMENT
C 2020-147 Communication (05/21/2020) from the Housing Director,
recommending Council approval of an Amended and Restated Ground Lease with
Pua Loke Housing Partners LP, a Hawai`i Limited Partnership, for the Pua Loke
Affordable Housing Development project, Tax Map Key (TMK) No (4) 3-8-005-028 &
029, Lihu`e, Kaua`i, Hawai`i

Councilmember Chock moved to approve C 2020-147, seconded by
Councilmember Kuah`i
Council Chair Kaneshiro Any discussion from the members on this item?
This is an Agreement that we approved at a prior meeting. There were a few changes
that needed to be made before they could finalize it It has been reviewed by the Office
of the County Attorney Councilmember Cowden
Councilmember Cowden I was just going to state what the change was
It was just a minor piece in there protecting the lender It is almost like a housekeeping
amendment It is significant to the lender, but not significant to the citizens here and
our moneys

Councilmember Kagawa I have a question
Council Chair Kaneshiro• Councilmember Kagawa
Councilmember Kagawa. This is a seventy-five (75)year ground lease for
affordable housing? Is that what it is?
Council Chair Kaneshiro. This is the new project that is going up right
behind Kukui Grove Cinemas.
Councilmember Kagawa. So we are giving them a seventy-five (75) year
lease for the land?
Council Chair Kaneshiro Yes
Councilmember Kagawa• In seventy-five (75) years, it comes back to the
County the ownership? Or it gets renewed?
Council Chair Kaneshiro. Yes. I believe the agreement is similar to what
we had for Kaniko`o at Rice Camp. We owned the land They built the buildings and
rented it out.

Councilmember Kagawa Okay It is like a rental program9
Council Chair Kaneshiro. Yes.
Councilmember Kagawa• You can own a house if you have mortgage on
leased land, but you do not own the land.
Council Chair Kaneshiro• This project is going to have rental units. It is
all part of our transition plan We have the project right across the street, across the
Department of Water, that is going to be for homeless people transitioning into a house.
These units are going to be for people that transition from that housing project across
the street into this housing Hopefully from this project they will be able to transition
into fair market value houses or some other type of housing project
Councilmember Kagawa• Good Thank you.
Council Chair Kaneshiro. Any other questions or discussion from the
members?

The motion to approve C 2020-147 was then put, and carried by a vote of 6 0 1*

Council Chair Kaneshiro. This concludes our Special Council Meeting
Not seeing or hearing any objections, this meeting is now adjourned.
There being no further business, the Special Council Meeting adjourned at
843 a m
