MARCH 29, 2017
The Special Council Meeting of the Council of the County of Kaua`i was called
to order by Council Chair Mel Rapozo at the Council Chambers, 4396 Rice Street,
Suite 201, Lihu`e, Kaua`i, on Wednesday, March 29, 2017 at 8:30 a.m., after which
the following Members answered the call of the roll:
Honorable Arthur Brun
Honorable Mason K. Chock
Honorable Ross Kagawa
Honorable Arryl Kaneshiro (present at 8:32 a.m.)
Honorable Derek S.K. Kawakami
Honorable Mel Rapozo
Excused: Honorable JoAnn A. Yukimura
APPROVAL OF AGENDA.
Councilmember Kawakami moved for approval of the agenda as circulated,
seconded by Councilmember Kagawa, and carried by a vote of 5:0:2
(Councilmembers Kaneshiro and Yukimura were excused).
Council Chair Rapozo: Motion carried. Can you read us into
Executive Session, please?
EXECUTIVE SESSION:
ES-899 Pursuant to Hawaii Revised Statutes (HRS) Sections 92-4,
92-5(a)(3), (4), and (8), and Kaua`i County Charter Section 3.07(E), the Office of the
County Attorney, on behalf of the County Administration, respectfully requests an
Executive Session with the Council to provide the Council with a briefing on the
current collective bargaining proceedings between the Employer Group and the
various Unions, and related matters. The briefing and consultation involves
consideration of the powers, duties, privileges, immunities, and/or liabilities of the
Council and the County as they relate to this agenda item.
Councilmember Kagawa moved to convene in Executive Session for
ES-899, seconded by Councilmember Chock.
Council Chair Rapozo: Is there any discussion? Is there any public
testimony?
There being no objections, the rules were suspended to take public testimony.

There being no one present to provide public testimony, the meeting was called
back to order, and proceeded as follows:
Council Chair Rapozo: Again, as I stated before we went on air, I am
not sure how long this Executive Session will take. It is a request of the
Administration, but we will come back out at 9:00 a.m. to proceed with the Capital
Improvement Project (CIP) Budget. If needed, we will go back into Executive Session
after we complete the CIP Budget. With that, roll call.
The motion to convene in Executive Session for ES-899 was then put, and
carried by the following vote:
FOR EXECUTIVE SESSION: Brun, Chock, Kagawa, Kawakami,
Rapozo TOTAL— 5,
AGAINST EXECUTIVE SESSION: None TOTAL— 0,
EXCUSED & NOT VOTING: Kaneshiro, Yukimura TOTAL— 2,
RECUSED & NOT VOTING: None TOTAL — 0.
Ms. Fountain-Tanigawa: Five (5) ayes.
(Councilmember Kaneshiro was noted as present.)
Council Chair Rapozo: We will recess at this point. We will
reconvene in the Executive Session chambers. Thank you.
ADJOURNMENT:
There being no further business, the Special Council Meeting adjourned at
8:32 a.m.
