HomeMy WebLinkAbout08/22/2018 Special Emergency Council minutes SPECIAL EMERGENCY COUNCIL MEETING AUGUST 22, 2018 The Special Emergency Council Meeting of the Council of the County of Kaua`i was called to order by Council Chair Mel Rapozo at the Council Chambers, 4396 Rice Street, Suite 201, Lihu`e, Kaua`i, on Wednesday, August 22, 2018 at 1:31 p.m., after which the following Members answered the call of the roll: Honorable Arthur Brun Honorable Mason K. Chock Honorable Arryl Kaneshiro Honorable Derek S.K. Kawakami Honorable JoAnn A. Yukimura (present at 1:35 p.m.) Honorable Mel Rapozo Excused: Honorable Ross Kagawa APPROVAL OF AGENDA. JADE K. FOUNTAIN-TANIGAWA, County Clerk: Council Chair Rapozo, pursuant to Hawai`i Revised Statutes Chapter 92, this Special Emergency Council Meeting is being requested by the County Administration to approve a supplemental money bill to appropriate one million dollars ($1,000,000) from the Reserve Fund, to be used for emergency preparation expenses in anticipation of the imminent threat posed by Hurricane Lane to the County of Kaua`i. This meeting has been posted and noticed, pursuant to Hawai`i Revised Statutes Section 92-8 Emergency Meetings. After consultation with the Office of the County Attorney and the Office of Information Practices, it was determined that this meeting qualified as an Emergency Meeting, as Hurricane Lane poses an imminent threat to public health, safety, and welfare. Given that information, two-thirds (2/3) of this body must agree that the findings are correct and that an emergency exists. In order to continue with this Emergency Meeting, it would be recommended that a motion is made to approve this agenda and to proceed with the Emergency Meeting pursuant to Hawai`i Revised Statutes Sction 92-8, as Hurriance Lane poses an imminent threat to public health, safety, and welfare of the people of Kaua`i. Councilmember Kaneshiro moved for approval of the agenda, as circulated, seconded by Councilmember Brun, and carried by a vote of 5:0:2 (Councilmembers Kagawa and Yukimura were excused). COMMUNICATION: C 2018-190 Communication (08/22/2018) from the Director of Finance, transmitting for Council consideration, a proposed Emergency Ordinance pursuant SPECIAL EMERGENCY COUNCIL MEETING 2 AUGUST 22, 2018 to Charter Sections 4.02K and 18.02, in the amount of$1,000,000.00 from the Reserve Fund (Disaster Response), which will be used for emergency expenditures in order to protect the health, safety, and welfare of the people of the County of Kaua`i in anticipation of the imminent threat of Hurricane Lane: Councilmember Kaneshiro moved to receive C 2018-190 for the record, seconded by Councilmember Brun, and carried by a vote of 5:0:2 (Councilmembers Kagawa and Yukimura were excused). Council Chair Rapozo: Motion carried. EMERGENCY BILL: Proposed Draft Bill (No. 2721)—AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO. B-2018-841, AS AMENDED, RELATING TO THE OPERATING BUDGET OF THE COUNTY OF KAUAI, STATE OF HAWAII, FOR THE FISCAL YEAR JULY 1, 2018 THROUGH JUNE 30, 2019, FOR THE PURPOSE OF FUNDING EMERGENCY EXPENDITURES TO MEET THE PUBLIC EMERGENCY CAUSED BY HURRICANE LANE, BY REVISING THE AMOUNTS ESTIMATED IN THE GENERAL FUND: Councilmember Kaneshiro moved to approve Proposed Draft Bill (No. 2721) pursuant to Kaua`i County Charter Section 4.02K and 18.02, and that it be transmitted to the Mayor for his approval, seconded by Councilmember Brun. Council Chair Rapozo: Is there any discussion or public testimony? There being no objections, the rules were suspended to take public testimony. There being no one present to provide testimony, the meeting was called back to order, and proceeded as follows: Council Chair Rapozo: Seeing none, roll call. (Councilmember Yukimura was noted as present.) The motion to approve Proposed Draft Bill (No. 2721) pursuant to Kaua`i County Charter Section 4.02K and 18.02, and that it be transmitted to the Mayor for his approval was then put, and carried by the following vote: FOR APPROVAL: Brun, Chock, Kaneshiro, Kawakami, Yukimura, Rapozo TOTAL — 6, AGAINST APPROVAL: None TOTAL — 0, EXCUSED & NOT VOTING: Kagawa TOTAL — 1, RECUSED & NOT VOTING: None TOTAL — 0. Ms. Fountain-Tanigawa: Six (6) ayes. Council Chair Rapozo: Thank you very much. With no further business, this concludes today's Special Emergency Council Meeting.
