RESOLUTION ESTABLISHING NO PARKING OF CERTAIN
VEHICLES ALONG PUHI ROAD,LIHU’E
WHEREAS,Chapter 16,Article 2 of the Kaua’i County Code 1987,as
amended,authorizes the Kaua’i County Council to create,define,re-define,
eliminate,or change all no-parking zones;and
WHEREAS,Chapter 16,Section 2.1 of the Kau&i County Code 1987,as
amended,authorizes the Kaua’i County Council to make such changes by resolution,
with any such changes being consistent with the current edition of the Manual on
Uniform Traffic Control Devices as published by the Federal Highway
Administration and the current edition of the County’s Street Design Manual as
published by the Department of Public Works;and
WHEREAS,Chapter 291C Statewide Traffic Code,Hawai’i Revised Statutes,
defines vehicle to mean every device in,upon,or by which any person or property is
or may be transported or drawn upon a roadway or highway;and
WHEREAS,Puhi Road is located in the Lihu’e District,County of Kaua’i,State
of Hawai’i;and
WHEREAS,residents along Puhi Road have complained about safety concerns
as a consequence of adjacent industrial businesses storing and parking heavy vehicles
along the grass shoulders and parking areas of Puhi Road;and
WHEREAS,the parking movement of these large vehicles often impedes traffic
along Puhi Road;and
WHEREAS,federal aid collector roads such as Puhi Road are primarily
intended for providing mobility and not intended for private commercial storage
purposes;and
WHEREAS,the Department of Public Works,based on an engineering and
traffic investigation has recommended parking restrictions along Puhi Road;now,
therefore,

BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF KAUA’I,
STATE OF HAWAI’I,that:
SECTION 1.No parking zones shall be established for vehicles with
six (6)or more wheels along both sides of Puhi Road from Kaneka Street to a point
approximately 450 feet south of its centerline intersection with Haleukana Street,as
shown on the map attached hereto as Exhibit “A”and incorporated herein by
reference.
SECTION 2.The Department of Public Works shall post appropriate
signs on the sections of Puhi Road where there is sufficient available space for
parking,to indicate the parking restriction that is established herein in accordance
with the provisions provided by law.
SECTION 3.Any person convicted of violating any provisions of the
Traffic Code of the County of Kaua’i,Chapter 16,Kaua’i County Code 1987,as
amended,shall be subject to the penalties prescribed in Section 16-21.6.
