ES-002 BOE 2022-01 Pursuant to Hawaii Revised Statutes §92-4 and �92-5 (a) and (2) and (4), the purpose of this Executive Session is for discussion and possible action on a notarized formal complaint received FebruM 8 2021 charging that an employee or officer of the County has breached the Code of Ethics as set forth in the Kaua'i County Charter section 20.02 B, 20.02 E and 20.02 F. Return to Open Ratify on Board actions taken in Executive Session. Member Toyfuku moved to ratify Session Open session resumed at 2:50 p.m. actions taken in Executive Session. Secretarty Ramos-Benzel seconded. Member Burriss left the meeting at 2:47 p.m. Motion carried 4:0 Ms. Ching Noted that there is no one in the audience. H. Communication BOE 2023-02 Possible conflict of interest and recusal dated January 25, 2023, from Vice Chair de la Pena moved to Council Chair Mel Rapozo on C 2023-22, relating to a claim filed against the County receive BOE 2023-02. Member of Kauai. Toyofuku seconded. Motion carried 4:0 BOE 2023-03 Disclosure of Interest dated January 23, 2023, from Francis DeGracia, Member Toyofuku moved to receive Planning Commission Chair, relating_ to the Planning_ Commission Agenda Item K. I., BOE 2023-03. Vice Chair de la Pena meeting on January 24, 2023. seconded. Motion carried 4:0 BOE 2023-04 Disclosure of Interest dated January 23, 2023, from Donna Apisa, Member Toyof iku moved to receive Planning Commission Vice Chair, relating to the Planning Commission Agenda Item BOE 2023-04. Vice Chair de la Pena K.1., meeting on January 24, 2023. seconded. Motion carried 4:0 BOE 2023-05 Letter from County Clerk Jade Fountain-Tanigawa dated February 1, Member Toyofuku moved to receive 2023, regarding the 2022 County of Kaua'i Lobbyist Registration.
