Public Comments and Testimony: •Written testimony will be accepted for any agenda item herein. o Written testimony indicating your 1) name, and if applicable, you position/title and organization you are representing, 2) the agenda item that you are providing comment on, and 3) contact information (telephone number and email address), may be submitted to asegreti@kauai.gov or mailed to the Charter Review Commission, c/o Office of Boards and Commission, 4444 Rice Street, Suite 300, Lihue, Hawaii 96766. o Written testimony received by the Charter Review Commission at least 24 hours prior to the meeting will be distributed to all Charter Review Commissioners prior to the meeting. o Any testimony received after this time and up to the start of the meeting will be summarized by the Clerk of the Commission during the meeting and added to the record thereafter. o Any late testimony received will be distributed to the to the members after the meeting is concluded. o •Oral testimony will be taken during the public testimony portion of the meeting. o It is recommended that anyone interested in providing oral testimony register at least 24 hours prior to the meeting by emailing asegreti@kauai.gov or calling (808) 241-4917. Any request to register shall include your 1) name, and if applicable, your position/title and organization you are representing, and 2) the agenda item that you are providing comment on, and 3) contact information (telephone number and email address). o Per the Charter Review Commission’s and Chairs practice, there is three-minute time limit per testifier per agenda item. o Individuals who have not registered to provide testimony will be given an opportunity to speak on an agenda item following the registered speakers. Approval of Agenda Vice Chair TenBruggencate asked if there were any changes to the agenda. Hearing no changes to the minutes it stood approved. D. Minutes Open Session Minutes of September 26, 2022 Vice Chair TenBruggencate entertained a motion to approve the minutes of September 26, 2022. Commissioner Kawane moved to approve the minutes of September 26, 2022 Commissioner Bautista seconded. Public Testimony None Administrator Ching noted for the record that no one was present in the audience. F. Communication None G. Business CRC 2022-20 Report/Presentation by Strategies 360, discussion, and possible action on public education digital campaign. John White, Senior Vice President, Strategies 360 went over the presented report on the public education digital campaign (on file) completed for the commission. The Commissioners engaged in discussion with Mr. White asking questions on what can be improved on and recommendations. They discussed using other forms of media, including print media that could have a QR code that people could scan. He emphasized that you have 5-7 seconds to get the attention of people and that you want ads to be fresh, quick, easily accessible. They discussed that many voters were probably using their phones to look at the digital media and how voters may have sat down and discussed ballot items with others while voting. They thought that people may have seen an ad on social media and went back to it to get more information and clarity once the ballot arrived. They pointed out that voter turnout for Kaua’i was best in the State, but less than the previous election year in the County. Commissioner Kawane moved to receive CRC 2022-20. Commissioner Bautista seconded. Motion carried 5:0 CRC 2022-21 Discussion on 2022 General Election Ballot Questions. Commissioner Kawane moved to receive the 2022 General Election summary report. Commissioner Bautista seconded. Motion carried 5:0 Charter Review Commission Open Session November 28, 2022 Page 3 SUBJECT DISCUSSION ACTION CRC 2022-22 Discussion and possible action on retaining a consultant to provide a report on districting and defining the scope of the report. Commissioner Kawane moved to have staff procure a proposal from a consultant to do a full study on pros and cons of districting and cost of districting. Commissioner Bautista seconded. Motion carried 5:0 CRC 2022-23 Discussion and possible action on sending letters to Commissions, Boards, Committees, Mayor, and Departments regarding Charter Amendment proposals to the Charter Review Commission. Administrator Ching asked for leeway to send out letters regarding recommendation for charter amendments to be more efficient. Vice Chair Tenbruggencate entertained a motion. Commissioner Kawane moved to authorize staff to seek recommendations by letter from commissions, boards, committees, the mayor and his departments and agencies on proposed Charter amendments. Commissioner Bautista seconded. Motion carried 5:0 CRC 2022-24 Election of Chair and Vice Chair for 2023 Calendar year. Commissioner Kawane moved to elect Commissioner Bautista as Chair, Commissioner Trujillo as Vice Chair. Commissioner Sandbloom seconded. Motion carried 5:0 CRC 2022-25 Discussion and possible approval of the 2023 meeting calendar. Meetings will continue the fourth Monday of each month, unless there is a holiday in which case it will be held the third Monday. Commissioner Kawane moved to approve the 2023 meeting calendar. Dahilig Managing Director DATE: December 27, 2022 RE: Meeting format (in-person, virtual or hybrid) ______________________________________________________________________________ In the early months of 2020 and at the start of COVID-19, County functions pivoted in variety of ways to maintain County operations and to safeguard public health and safety. As we learned more about how to mitigate the impacts of COVID-19 and the Governor ended the last emergency proclamation related to COVID-19 in March 2022, we started a return to our normal operations. Since then, the County’s Boards, Commissions, and Committees have conducted in-person meetings, virtual meetings, or a hybrid of both – and both types of meeting formats are allowed under a newly revised Chapter 92, Hawaii Revised Statutes. We understand each Board, Commission, Committee, and its members are unique and have unique needs. Thus, rather than issue a blanket directive fr om our office on how meetings should be conducted, it is prudent to leave that decision to each individual Board, Commission and Committee to determine what works best for your members as a body to be able to conduct business accordingly whether it be hybrid, all digital, or only in-person.
