HomeMy WebLinkAbout08_03_2022 Public hearing minutes on BILL 2873PUBLIC HEARING AUGUST 3, 2022 A public hearing of the Council of the County of Kaua`i was called to order by Bill DeCosta, Chair, Public Works & Veterans Services Committee, on Wednesday, August 3, 2022, at 8:31 a.m., at the Council Chambers, 4396 Rice Street, Suite 201, Historic County Building, Lihu`e, and the presence of the following was noted: Honorable Bernard P. Carvalho, Jr. Honorable Mason K. Chock Honorable Felicia Cowden Honorable Bill DeCosta Honorable Luke A. Evslin Honorable KipuKai Kuali`i Honorable Arryl Kaneshiro The Clerk read the notice of the public hearing on the following: Bill No. 2873 — A BILL FOR AN ORDINANCE ADDING A NEW ARTICLE TO CHAPTER 15, KAUAI COUNTY CODE 1987, AS AMENDED, RELATING TO BUILDING AND CONSTRUCTION REGULATIONS," which was passed on first reading and ordered to print by the Council of the County of Kaua`i on July 6, 2022, and published in The Garden Island newspaper on July 14, 2022. The following communications were received for the record: 1. Contractors Association of Kaua`i, dated August 2, 2022 2. Pacific Resource Partnership, dated August 2, 2022 The hearing proceeded as follows: Committee Chair DeCosta:Is there anyone in the audience wishing to testify. We do have two (2) testifiers on Zoom. I would like to call upon Nathaniel Kinney. NATHANIEL KINNEY (via remote technology): Good morning, Council Chair and Councilmembers. Committee Chair DeCosta:You will need to state your name for the record and you will have six (6) minutes. You will see the green light. When you have thirty (30) seconds left you will see the yellow light. When your time is up, you will see the red light. You may proceed, Nathaniel. PUBLIC HEARING 2 AUGUST 3, 2022 BILL NO. 2873 Mr. Kinney: My name is Nathaniel Kinney on behalf of the Hawai`i Regional Council of Carpenters. We would like to testify in support of Bill No. 2873. We had a nice chat with the Administration about some of the changes they were going to propose. Those changes, from what I understand, limit this Disclosure Bill to non-residential building permits and larger projects. We feel that this is a good step forward to avoid any unnecessary paperwork for smaller residential projects or additions to those smaller residential projects, which is really not the intent of trying to catch cheaters and contractors who have no intention of following the law with this Disclosure Bill. I am sure that the Bill in its amended form is in front of you right now. We are supportive of that, and we think that those are reasonable changes to make in light of unnecessary paperwork that should not have to be filed by smaller contractors that are doing smaller work. Thank you. Committee Chair DeCosta:Thank you very much. Next, I would like to call on Francis DeGracia. FRANCIS DEGRACIA (via remote technology):Good morning, Councilmembers. I am with the Hawai`i Regional Council of Carpenters and I am the Field Representative on the island of Kauai. I would just like to echo Nathaniel's comments on this Bill in support of Bill No. 2873 and narrowing it down to assisting and identifying these bad actors on the island, while not creating more paperwork and making it difficult for the normal homeowners trying to build. We do not want to stop or hinder the process. We are ready to work with the Administration and the Council in creating something that will help with identifying these bad actors on the island and making this Bill very effective. Thank you.
