HomeMy WebLinkAbout6.263 6.264 LIQUOR CONTROL INVESTIGATOR I & II 20240410PART I DEPARTMENT OF HUMAN RESOURCES COUNTY OF KAUAI 6.263 6.264 Class Specifications for the Class: LIQUOR CONTROL INVESTIGATOR I & II SR-16, BU-03 SR-18, BU-03 Duties Summary: Inspects premises where intoxicating liquors are manufactured, sold and/or consumed and enforces applicable State and local liquor laws; investigates apparent or suspected liquor law violations and prepares report on findings; and performs other related duties as required. Distinguishing Characteristics: These classes are distinguished by their responsibility to perform inspectional and investigative tasks relative to the enforcement of liquor laws, rules, and regulations. Level I: This level is characterized by performing inspectional tasks within an assigned geographical area to enforce liquor laws, rules, and regulations, and by conducting investigations primarily involving observed or apparent liquor law violations. Level II: This level is characterized by performing inspectional tasks within an assigned geographical area to enforce liquor laws, rules, and regulations, and by conducting the more complex investigations involving alleged or suspected liquor law violations where there is a greater requirement for follow-up and the development of facts, evidence, and conclusions. Examples of Duties: (The following are examples of duties and are not necessarily descriptive of any one position in this class. The omission of specific duties statements does not preclude management from assigning such duties if such duties are a logical assignment for the position). • Conducts periodic inspections of licensed liquor establishments and enforces State liquor laws and the rules and regulations of the Liquor Control Commission of the County of Kauai; • Observes and ascertains whether licensees are complying with the terms and conditions of their respective licenses; • Checks for liquor law violations such as serving liquor to minors, to persons at the time under the influence of liquor and to persons known by the licensee to be addicted to the excessive use of liquor; PART I LIQUOR CONTROL INVESTIGATOR I & II 2 6.263 6.264 • Checks on the sale, service or consumption of liquor on or within any licensed premises before or after hours established by the Liquor Control Commission, the sale or offer of sale or offer of sale of a drink which contains less than one fluid ounce of liquor, employees consuming liquor while on duty or any other misconduct of employees, the "stacking" of liquor for consumption by patrons, the possession of liquor by a licensee other than that authorized by the license, the selling or serving of liquor by the licensee or his employee outside of the licensed premises; • Checks entertainment in licensed premises to see that the conditions of entertainment permits are carried out and that amusement devices or equipment on premises are properly licensed; • Boards vessels in port and checks for compliance with liquor laws, rules, and regulations; • Initiates and conducts investigations of apparent or suspected liquor violations which may involve the examination of business records and books, the interviewing of witnesses and principal parties and the seizure of physical evidence; • Prepares reports on findings and cites pertinent provisions of laws or rules violated; • May operate as a member of a team on special assignments such as for stakeouts, surveillance of trouble spots and similar occasions where two or more positions have to be deployed; • Serves subpoenas to witnesses and testifies before the Liquor Control Commission or in court; • Resolves minor discrepancies with licensees and interprets and explains applicable liquor laws and rules to licensees and other interested persons; prepares and submits activity reports of inspectional tours; • May exercise power of arrest as circumstances warrant; and • Performs other related duties as assigned. Knowledge of: Laws, rules, and regulations governing the manufacture, importation, and sale of liquors in the County of Kauai; principles and techniques of inspection and investigation applicable to the work involved; standard methods used by business establishments for keeping records; rules of legal evidence and laws of arrest; court procedures; functions and jurisdiction of other enforcement agencies. PART I LIQUOR CONTROL INVESTIGATOR I & II 3 6.263 6.264 Ability to: Interpret and explain laws, rules, and regulations; meet and deal effectively with a wide variety of people and elicit necessary information; gather, verify, and evaluate facts and evidence; prepare clear and concise reports. This is an amendment to the specification for the class, LIQUOR CONTROL INVESTIGATOR I &II, which was approved on May 26, 1971, amended on August 6, 1997, and on August 26, 2021, and is to be substituted for that specification. ANDERSON Director of Human Resources PART II DEPARTMENT OF HUMAN RESOURCES COUNTY OF KAUAI 6.263 6.264 Minimum Qualification Specifications for the Class: LIQUOR CONTROL INVESTIGATOR I & II SR-16, BU-03 SR-18, BU-03 Training & Experience: A combination of education and experience substantially equivalent to graduation from high school; and Level I: • three and one half (3 ½) years of specialized work experience. Level II: • three and one half (3 ½) years of specialized work experience; and • one (1) year of work experience in a liquor law enforcement program. Qualifying Specialized Work Experience: Work experience which involved the examination, interpretation, and/or application of laws, ordinances, rules and regulations, and/or policies and procedures. Substitutions Allowed: The following may be substituted for education: A. Four (4) years of full-time general work experience may be substituted for a high school diploma. B. Successful completion of semester credits leading towards a degree or diploma from an accredited community college, college or university, trades school, etc., may be substituted for up to four (4) years of the education requirement (15 semester credits = 6 months). C. An Associate’s, Bachelor’s, Master’s, or PhD degree from an accredited community college, college or university, trades school, etc., may be substituted for the education requirement. PART II LIQUOR CONTROL INVESTIGATOR I & II 2 6.263 6.264 The following may be substituted for experience: A. Successful completion of semester credits leading towards a degree or diploma from an accredited community college, trades school, may be substituted for up to four (4) years of the specialized work experience requirement (15 semester credits = 6 months). B. An Associate’s degree from an accredited community college, business, or technical school, may be substituted for two (2) years of the specialized work experience requirement. C. A Bachelor’s degree from an accredited college or university may be substituted for up to four (4) years of the specialized work experience requirement. D. A Master’s or PhD degree from an accredited college or university may be substituted for up to one (1) year of the specialized work experience requirement. If a degree is used to substitute for the education requirement, it may not be used again towards the experience requirement. If work experience is used to substitute for education, it may not be used again to meet the experience requirement. If the applicant holds more than one degree, transcripts must be provided, and a thorough review will be conducted by the human resources staff in order for more than one degree to be credited towards the minimum qualification requirements. Additional degrees can be considered if obtained independently through mutually exclusive classes from another degree being considered. Substitutions will be used to the advantage of the applicant. Quality of Experience: Possession of the required number of years of experience will not in itself be accepted as proof of qualification for a position. The applicant's overall experience must have been of such scope and level of responsibility as to conclusively demonstrate that they have the ability to perform the duties of the position for which they are being considered. License Requirement: Possession of a valid motor vehicle operator’s license (Hawaii type 3 or equivalent) and appropriate licenses or certificates as required of the position. Selective Certification: Specialized knowledge, skills and abilities may be required to perform the duties of some positions. For such positions, Selective Certification Requirements may be established, and certification may be restricted to eligibles who possess the pertinent experience and/or training required to perform the duties of the position. PART II LIQUOR CONTROL INVESTIGATOR I & II 3 6.263 6.264 Departments/Agencies requesting Selective Certification must show the connection between the kind of training and/or experience on which they wish to base selective certification and the duties of the position to be filled. Tests: Applicants may be required to qualify on an appropriate examination. Health and Physical Condition Requirements: Persons seeking appointment to positions in this class must meet the health and physical condition standards deemed necessary and proper to perform the essential functions of the position with or without reasonable accommodations. Physical Effort Grouping: Light Special Working Conditions: Irregular hours, shift, weekend, and holiday work as required.
