OCTOBER 9, 2024
(Note: Due to the extended power outage that occurred on October 7, 2024, a portion
of the October 9, 2024 Kaua'i County Council Meeting experienced technical
difficulties relating to connection with Granicus, rendering the meeting's courtesy
livestream unavailable. The meeting proceeded, as stated in the official meeting
agenda, which reads in pertinent part: "If the courtesy livestream is unavailable for
any reason, the meeting will proceed.")
A public hearing of the Council of the County of Kaua'i was called to order by
Mel Rapozo, Council Chair, on Wednesday, October 9, 2024, at 9:20 a.m., at the
Council Chambers, 4396 Rice Street, Suite 201, Historic County Building, Lihu'e, and
the presence of the following was noted:

The Clerk read the notice of the public hearing on the following:
"Bill No. 2933 -
A
BILL FOR AN ORDINANCE AMENDING
CHAPTER 8, KAUA'I COUNTY CODE 1987, AS AMENDED, RELATING TO
THE COMPREHENSIVE ZONING ORDINANCE , INCLUDING MATTERS
PERTAINING TO GUEST HOUSES (Kaua'i County Council, Applicant)
(ZA-2024-3 -Planning Commission Recommendation)
which were passed on first reading and ordered to print by the Council of the County
of Kaua'i on September 11, 2024, and published in The Garden Island newspaper on
September 19, 2024.

Council Chair Rapozo: Thank you. I assume that there 1s no
testimony via Zoom. Are there any written testimonies?

Council Chair Rapozo: All of the Council should have a copy at your
desk. Is there anyone registered to speak?
Ms. Fountain-Tanigawa: There are no registered speakers.

Councilmember Cowden: Those two (2) people also want to testify.
Council Chair Rapozo:

BRUCE HART: For the record, Bruce Hart. When this first
came out, I was tentatively in support. You are all aware that this Bill will progress
and there will be a lot of discussion, and I am hoping to hear from every
Councilmember, your thoughts and concerns. I would also like to express, because I
know that the Administration is watching, I would like to hear what the
Administration has to say. I would like to hear what the Planning Department has
to say, and I am looking forward to that. I have had a long-standing position in regard
to any increase in density. As you increase density, you increase noise. The other
position is in regards to one (1) off-street parking. I believe that there should be
two (2). I find it difficult to believe that there will be only one (I) person living in that
guest house. Even if there is only one (I) person, there still should be two (2) parking
spaces. I am reiterating my long-standing position. I would also like to ask ... I went
over to the Planning Department this morning, and I picked these up. I would like to
understand the changes that this Bill, if it passes as it is, amended ... what changes
will be made, because I do not fully understand what is being proposed by this Bill. I
am sure that I will as it progresses, but I also think that if the public ... these are free
from the Planning Department. They explain our zoning designations, so I am hoping
that the two (2) introducing councilmembers, Council Chair Rapozo and
Councilmember DeCosta, can help the public and myself better understand the
impact that this Bill will have. Thank you very much.
