PLANNING COMMITTEE
November 25, 2009
A meeting of the Planning Committee of the Council of the County of
Kauai, State of Hawaii, was called to order by Councilmember Daryl W. Kaneshiro,
Vice Chair, at the Historic County Building, Room 201, Lihu`e, Kauai, on
Wednesday, November 25, 2009, at 10:39 a.m., after which the following members
answered the call of the roll:
Honorable Tim Bynum
Honorable Jay Furfaro (present at 10:40 a.m.)
Honorable Daryl W. Kaneshiro
Honorable Lani T. Kawahara
Honorable Derek S. K. Kawakami
Honorable Bill "Kaipo" Asing, Ex-Officio Member
Honorable Dickie Chang, Ex-Officio Member
DARYL W. KANESHIRO: The Vice... are we ready? We're on? Thank
you. Good morning, the Vice Chair of the Planning Committee calls this meeting to
order. At this time I would like to recess the Planning Committee.
There being no objections, the Committee recessed at 10:40 a.m.
The Committee reconvened at 1:35 p.m., and proceeded as follows:
JAY FURFARO: Okay thank you very much we're back from lunch
break and I am going to call to order the Planning Committee. I would like to make
note that all members are present. Mr. Kawakami is in the building and will be
joining us shortly. The first item is the minutes of the November 10, 2009 Planning
Committee meeting.

TIM BYNUM: Move to approve.
Mr. Kaneshiro: Seconded.
Mr. Furfaro: Any discussion? All those in favor say "aye"
Committee Members: Aye.
Mr. Furfaro: Thank you very much.
Upon motion duly made by Councilmember Bynum, and seconded by
Councilmember Kaneshiro, and unanimously carried, the Minutes of the
November 10, 2009 Planning Committee Meeting was approved.
Mr. Furfaro: The next item I would like to have read is Bill No.
2298 please.
Bill No. 2298 A BILL FOR AN ORDINANCE TO AMEND
CHAPTER 8, KAUAI COUNTY CODE 1987, AS
AMENDED, RELATING TO THE
COMPREHENSIVE ZONING ORDINANCE AND
SINGLE-FAMILY TRANSIENT VACATION
RENTALS
[This item was deferred to December 9, 2009.]
Mr. Furfaro: Thank you very much. I do want to share with my
colleagues before I ask for public testimony that... the County Attorney has recently
been made aware of some new concerns regarding this bill and as such I am
requesting that the County Attorney brief us in a future scheduled Executive
Session regarding legal issues that we must consider before we take action on this
bill. So I'm asking for a deferral until December 9th if that's acceptable with the
group, that's what I'm looking for in the Committee but before I get to that point, I
would ask is there any written testimony?
None. Is there anyone in the audience that would like to testify? There is
none. I call the Committee back to order, and I am looking for a motion to defer to
date specific December 9th
Mr. Kaneshiro: So moved to defer to December 9th
Mr. Kawakami: Seconded.
Upon motion duly made by Councilmember Kaneshiro, and seconded by
Councilmember Kawakami, and unanimously carried, Bill No. 2298 was
deferred to December 9th.
Mr. Furfaro: Thank you. No discussion, all those in favor say
"aye".
Committee Members: Aye.
Mr. Furfaro: Thank you very much. That is the amount of
business in the Planning Committee at this time so I'm going to go ahead and
adjourn my Committee.
There being no further business, the meeting was adjourned at 1:38 p.m.
