Home My WebLink About10-14-2009 Planning Commitee Minutes MINUTES PLANNING COMMITTEE October 14, 2009 A meeting of the Planning Committee of the Council of the County of Kauai, State of Hawaii, was called to order by Councilmember Jay Furfaro, Chair, at the Historic County Building, Room 201, Lihu`e, Kauai, on Wednesday, October 14, 2009, at 9:10 a.m., after which the following members answered the call of the roll: Honorable Tim Bynum Honorable Jay Furfaro Honorable Daryl W. Kaneshiro Honorable Derek S. K. Kawakami Honorable Bill "Kaipo" Asing, Ex-Officio Member EXCUSED: Honorable Lani T. Kawahara EXCUSED: Honorable Dickie Chang, Ex-Officio Member Minutes of the September 16, 2009 Planning Committee Meeting. Upon motion duly made by Councilmember Bynum, seconded by Councilmember Kaneshiro, and unanimously carried, the Minutes of the September 16, 2009 Planning Committee Meeting was approved. The Committee proceeded on its agenda items as follows and as shown in the following Committee reports which are incorporated herein by reference: JAY FURFARO: I would like to go and make a consideration of an order of the bills today, there is a circulated memorandum from myself as chairman, asking that we would hear Bills 25... 2325, 2322, 2319 and 2298 all in the same order because they do deal with the particulars of 1 (one) transaction. May I have those four items read. CR-PL 2009-07: on Bill No. 2326 A BILL FOR AN ORDINANCE AMENDING ZONING CONDITIONS IN ORDINANCE NO. PM-2006-383, RELATING TO ZONING DESIGNATION IN NAWILIWILI, KAUAI (MORI Golf (Kaua`i), LLC., Applicant) [Approved as Amended.] CR-PL 2009-08: on Bill No. 2324 A BILL FOR AN ORDINANCEAMENDING STATE_LAND USE DISTRICT BOUNDARY IN NAWILIWILI, KAUAI (MORI Golf (Kaua`i) LLC., Applicant) [Approved.] CR-PL 2009-09: on Bill No. 2325 A BILL FOR AN ORDINANCE AMENDING ORDINANCE NO. PM-2006-382,RELATING TO GENERAL PLAN DESIGNATION IN NAWILIWILI, KAUAI (MORI Golf (Kaua`i), LLC., Applicant) [Approved.] CR,-PL 2009-10: on Bill No. 2327 A BILL FOR AN ORDINANCE AMENDING ORDINANCE NO. PM-2006-384, RELATING TO VISITOR DESTINATION AREA DESIGNATION IN NAWILIWILI, KAUAI (MORI Golf (Kaua`i), LLC., Applicant) [Approved.] CR,-PL 2009-11: on Bill No. 2322 A BILL FOR AN ORDINANCE TO AMEND CHAPTER 8, KAUAI COUNTY CODE 1987, AS AMENDED, RELATING TO THE COMPREHENSIVE ZONING ORDINANCE (ADU Building Permit deadline extension for non-residentially zoned land) [Approved.] Mr. Furfaro: Thank you very much, I'm going to ask if I can take a ten (10) minute break just because I need to get a drink of water. Oh we'll do a caption break here at 10:30 ,ten (10) minutes, thank you very much. There being no objections, the Committee recessed at 10:30 a.m. ThE Committee reconvened at 10:49 a.m., and proceeded as follows: Bill No. 2298 A BILL FOR AN ORDINANCE TO AMEND CHAPTER 8, KAUAI COUNTY CODE 1987, AS AMENDED, RELATING TO THE COMPREHENSIVE ZONING ORDINANCE AND SINGLE-FAMILY TRANSIENT VACATION RENTALS [This item was deferred to November 10, 2009.] Mr. Furfaro: Okay we're going to call the Planning Committee back to order; could I have the attention in the gallery as well. And I do want to make a special note for those of you that might be here dealing with the ADU piece on Ag land for TVR use, there has been a written request by the County Attorney to in fact defer this item for at least four (4) weeks which would not put it back on County Council's agenda until Tuesday 11/10 and the reason that meeting is on a Tuesday is in the month of November there's two (2) holidays that fall so November ten (10) is a Tuesday instead of a Wednesday for the Council meeting in the month of our Thanksgiving celebration so there is going to be a motion later to defer that item and I might actually asked for that item to be read now so that we can act on the County Attorney's request. Ms. Simao: Bill No. 2298 A bill for an ordinance to amend Chapter 8, Kauai County Code 1987, as amended, relating to the Comprehensive Zoning Ordinance and Single-Family Transient Vacation Rentals. Mr. Furfaro: Thank you very much. As stated earlier there is a circulated memorandum from the County Attorney asking for a deferral on this, do we have any testimony before I ask for a deferral? No? Thank you very much. May I look to my members to ask for a motion. TIM BYNUM: I move to defer this bill till November 10, 2009. Mr. Furfaro: Thank you very much. 2 DARYL W. KANESHIRO: Seconded. Mr. Furfaro: Thank you. All those in favor, please say "aye". Committee Members: Aye. Mr. Furfaro: Thank you very much. - Upon motion duly made by Councilmember Bynum, and seconded by Councilmember Kaneshiro, and unanimously carried, Bill No. 2298 was deferred to November 10, 2009. Mr. Furfaro: Thank you very much. We will now go to the next item on the Planning Committee's agenda. CR-PL 2009-12: on Bill No. 2319 A BILL FOR AN ORDINANCE TO AMEND CHAPTER 8, KAUAI COUNTY CODE 1987, AS AMENDED, RELATING TO THE COMPREHENSIVE ZONING ORDINANCE (Amending Article 27, Chapter 8, Kauai County Code 1987, relating to Shoreline Setbacks and Coastal Protection) [Approved as Amended.] There being no further business, the meeting was adjourned at 11:25 a.m. Respectfully submitted, Darrellyne .
