PUBLIC WORKS/ELDERLY AFFAIRS COMIVIITTEE
August 26, 2009
A meeting of the Public WorkslElderly Affairs Committee of the Council of the
County of Kauai, State of Hawaii, was called to order by Councilmember Tim Bynum,
Chair, at the Historic County Building, Room 201, Lihu`e, Kauai, on Wednesday,
August 26, 2009, at 11:59 a.m., after which the following members answered the call of the
roll:

Honorable Bill "Kaipo" Asing, Ex-Officio Member
Honorable Lani T. Kawahara, Ex-Officio Member
EXCUSED: Daryl W. Kaneshiro
TIM BYNUM: I call to order this session of the Public Works and Elderly
Affairs Committee. Let the record reflect that Councilmember Kaneshiro is absent and
excused, and if the Clerk could read the first item please.
The Committee proceeded on its agenda items as shown in the following Committee
reports which are incorporated herein by reference, and as follows:
DARRELLYNE SIMAO: PWE 2009-2 Communication (7/22/2009) from Tim
Bynum, Committee Chair, requesting that the Director of Parks and Recreation, Director
of Planning, and the County Engineer be present to provide an update on the short-term
and long-term efforts to address the drainage issues at Po`ipu Beach Park.
Mr. Bynum: Do staff know if the Planning Director or somebody
from Planning Department is available? Maybe we should move this to a different part of
the agenda?
Mr. Furfaro: I don't think there is much left of the agenda to tell
you the truth Mr. Bynum. You want to move on to another item in your Committee?
Mr. Kawakami: Why don't we go eat lunch, because I'm hungry.
Mr. Bynum Can we move to the next item and because we're
going to... Can you read the next item?

There being no objections, PWE 2009-2 was moved to the end of the agenda.
PWE 2009-3 Communication (7/22/2009) from Tim Bynum, Committee Chair,
requesting that the Mayor and County Engineer be present to provide
an update on the status of all CIP projects.
[This item was deferred.]
Ms. Simao: PWE 2009-3 Communication (7/22/2009) from Tim
Bynum, Committee Chair, requesting that the Mayor and County Engineer be present to
provide an update on the status of all CIP projects.
Mr. Bynum: Let me just say that it's my intention to ask for a
deferral of this matter with an explanation. Prior to that I want to see if there's anyone in
the audience that intended to testify on the matter? Seeing none, this is a communication
from myself to the Administration to do a review of CIP projects, I've been in dialog with
them for some time because of key members being off island and also a request for some
information in writing that we haven't received yet. There was a request from them to
wait 2 more weeks and this is an important matter that... and plus I was going to ask for
a deferral anyway because I believe Councilmember Kaneshiro would be an important
person to be involved in this as well so for those reasons is there any further discussions?
Councilmember Kawakami.
Mr. Kawakami: Mr. Chair thank you. Move to defer.
Ms. Kawahara: Seconded.
Mr. Bynum: All those in favor?
Committee Members: Aye.
Mr. Bynum: None opposed, motion carried.
Upon motion duly made by Councilmember Furfaro, seconded by
Councilmember Chang, and unanimously carried, PWE 2009-3 was deferred.
Mr. Kawakami was noted recused on Bill No. 2321 at 12:05 p.m.
CR-PWE 2009-04: on Bill No. 2321 A BILL FOR AN ORDINANCE ESTABLISHING A
NEW ARTICLE 19, CHAPTER 22, KAUAI
COUNTY CODE 1987, RELATING TO PLASTIC
BAG REDUCTION
[Approved as Amended.]

Mr. Kawakami was noted present in the meeting at 12:20 p.m.
CR-PWE 2009-05: on PWE 2009-2 Communication (7/22/2009) from Tim Bynum,
Committee Chair, requesting that the Director of
Parks and Recreation, Director of Planning, and
the County Engineer be present to provide an
