HomeMy WebLinkAboutSUB June 22 2010KAUAI PLANNING COMMISSION SUBDIVISION COMMITTEE MEETING June 22, 2010 The regular meeting of the Planning Commission Subdivision Committee was called to order by Chair, James Nishida at 8:32 a.m., at the Lihue Civic Center, Mo'ikeha Building, in Meeting Room 2A -213. The following Committee members were present: Mr. Jan Kimura Mr. James Nishida Ms. Camilla Matsumoto Discussion of the meeting, in effect, ensued: APPROVAL OF THE AGENDA On motion made by Camilla Matsumoto and seconded by Jan Kimura, to approve the agenda, motion carried unanimously by voice vote. On motion made by Camilla Matsumoto and seconded by Jan Kimura, to approve meeting minutes of May 25, 2010, motion carried unanimously by voice vote. GENERAL BUSINESS MATTERS There were no general business matters. COMMUNICATION There were no communications. UNFINISHED BUSINESS There was no unfinished business. NEW BUSINESS Tentative Subdivision Action, S- 2010 -08, Enrico Sautelli Jr. Trust/Scott F. Schweimer TrustlRomer M. & Judy Peckeupaugh, 3 -lot Boundary Adjustment, TMK: 2 -5- 001:001, 009, 010, Lawa`i, Kauai. Staff Planner Dale Cua: Thank you Mr. Chair. What you have before you in this application is a proposed 3 -lot boundary adjustment between existing properties in Lawa`i. This property is situated on the mauka side of Lawa`i just before the Lawa`i mortuary so as you are Subdivision Committee Minutes June 22, 2010 heading west it is before that intersection on the hillside to your right. The primary intent of this proposal is to resolve an encroachment situation with the driveway that serves as access for all three of the lots. The preliminary subdivision map has been routed to the various reviewing agencies for their comment. We have received all of the agency's reviews and they have been incorporated into the subdivision report. As a result the department is recommending tentative subdivision approval of this application. I would also like to note that the applicant has previously applied for a boundary adjustment 5 years ago but the application expired so basically they are reapplying again. Chair: Questions for Dale? Ms. Matsumoto: Were there any issues back then? Staff: It is basically to resolve the same issue which is to resolve the encroachment of the driveway. Chair: Is that easement 5? Staff: Yes. Chair: That dotted line, and what about easement 1, does that still stay? Staff: That easement 1 is preexisting. Chair: And easement 5 is the one that is going to disappear or that remains there but the driveway; they will be able to move the driveway? Staff: Yes, basically, I think as I previously noted if you notice this driveway climbs up a hillside and that is why you see it meandering through the property. And at the time it was constructed it wasn't consistent, the pole portion of the flag lot wasn't consistent with the location of the driveway. So essentially what they are trying to do is locate that existing driveway within the pole section of that back lot identified as lot 203 -A(1). Ms. Matsumoto: To make it consistent. Staff: Yes, in that boundary. Mr. Kimura: So right now that is easement 14? Staff: Easement 14 is preexisting as well. Chair: Alan, anything to add? Mr. Alan Hironaka: No we have no questions. At this time we don't have any questions. We went through the tentative requirements and we are agreeable to that. Chair: Questions for the applicant? What does the committee want to do? Mr. Kimura: I would like to move to approve tentative subdivision action for S- 2010 -08, Enrico Santelli Jr. Trust /Scott F. Schweiger Trust/Roger M. & Judy Peckenpaugh, 3 -lot boundary adjustment, TMK: 2 -5- 001:001, 009, 010, Lawa`i, Kauai. Ms. Matsumoto: Second. Chair: Moved and seconded, all those in favor say aye, opposed, motion carries. On motion made by James Nishida and seconded by Camilla Matsumoto, to approve tentative subdivision request for S- 2010 -08, motion carried unanimously by voice vote. Tentative Subdivision Action, S- 2010 -10, John Ka`ana`ana, 2 -lot Subdivision, TMK: 4- 1- 008:026, Wailua Houselots, Kauai. Staff Planner Dale Cua: Thank you Mr. Chair. What you have before you is a proposed 2 -lot subdivision in Wailua Houselots. It is a straight forward subdivision from one single lot to two lots. One of the lots will be a flag pole. The preliminary map has been routed to the various reviewing agencies and all of their requirements have been incorporated into the subdivision report. As a result the department is recommending tentative subdivision approval of this application. Chair: Questions for Dale? Mr. Kimura: What do you mean by collector street? Staff: In the County there are four classifications of roadways. The lowest classification is a dead end street and it is kind of based on traffic intensity on this roadway. So the more intense the use of the roadway the wider they are so the lowest one would be like a dead end street and then the neat classification would be a minor, collector is the second most intense and the most intense roadway is a major street. So a collector street, it is usually a wider roadway and that is because it probably stretches kind of far and there is a lot of traffic on this roadway. So Haleilio Road is the primary roadway that intersects with the highway at that Brick Oven Pizza location at Wailua Houselots. Chair: Any more questions for Dale? Mr. Hironaka: Again, Alan Hironaka, Hironaka Surveying and Mapping representing the client John Ka`ana`ana. Chair: Do you have anything to add? Subdivision Committee Minutes June 22, 2010 Mr. Hironaka: No. Most of the comments are pretty standard comments. I have no questions. Chair: Questions for the applicant? Mr. Hironaka: I would like to add one comment. Commissioner Kimura, you asked about the collector, right now the roadway width on Haleilio is 40 and the collector is 56 so that is why it is an 8 foot setback that is required on both sides. And then the end result will end up 56 feet. Mr. Kimura: It says 56 feet, the collector, is the second most used, why does it say "vehicular access into collector should be discouraged "? Staff: What they try to do is when you have like a mentioned the most intense roadway which would be a major street, often times access is discouraged from, direct access onto those roadways are discouraged. In this particular case the lot was preexisting and access onto this roadway is onto Haleilio but when you go through the subdivision process it has been the department's requirement that you try to minimize access points along collector streets. So in this particular case we are encouraging the subdivider to share a common driveway. And at the same time the requirement is done for safety purposes. We try to minimize the number of driveways along major roadways. Ms. Matsumoto: So according to this diagram they are going to make a left or right into this driveway, this long driveway and share that part. Staff: Exactly. Ms. Matsumoto: Is there a carport or something for the existing dwelling? Staff: Probably not so if anything they usually park out in the yard. Ms. Matsumoto: Because I see this other exiting dwelling there is a garage up top but this one doesn't have. And is there, can the owner make a driveway anywhere? Staff: No, it would be only within that easement area. If you look on the subdivision map you note there is an easement 1, and the purpose of the easement is for access for utility purposes. Chair: Any other questions? What does the committee want to do? Ms. Matsumoto: Move to approve for action tentative action S- 2010 -10, John Ka`ana`ana, TMK: 4 -1- 008:026, WailuaHouselots, Kauai.
