HomeMy WebLinkAboutSUB Mar 9 2010KAUAI PLANNING COMMISSION SUBDIVISION COMMITTEE MEETING March 9, 2010 The regular meeting of the Planning Commission Subdivision Committee was called to order by Chair, Mr. James Nishida at 8:00 a.m., at the Lihue Civic Center, Mo'ikeha Building, in Meeting Room 2A -213. The following Committee members were present: Mr. Jan Kimura Mr. James Nishida Ms. Camilla Matsumoto Discussion of the meeting, in effect, ensued: APPROVAL OF THE AGENDA On motion made by Camilla Matsumoto and seconded by Jan Kimura, to approve the agenda, motion carried unanimously by voice vote. GENERAL BUSINESS MATTERS There were no general business matters. COMMUNICATIONS There were no communications. UNFINISHED BUSINESS There was no unfinished business. NEW BUSINESS Tentative Subdivision Action, S- 2010 -07, Cornerstone Hawaii Holdings, LLC., 3 -lot Boundary Adjustment, TMK: 4 -7- 002:003, Kealia, Kaua'i. Staff Planner Dale Cua: Thank you Mr. Chair. As noted in the subdivision report what you have before you is a boundary adjustment and the intent is to relocate two existing Kuleanas on the parcel. For your information the parcel is situated mauka of Hauaala Road, right at the Spalding Monument intersection, right at the intersection of Kealia Road and Hauaala Road where you have the Spalding Monument the property is situated mauka, all the lands from mauka on. This is what the application involves. The subdivision map has been routed to the various reviewing agencies for their review and comment. All of those requirements have been incorporated into the subdivision report. The department did have a concern about the size of the relocated lots and basically we are encouraging the applicant to retain the existing land area of the Kuleanas. I think it is noted in condition 1(m) of the subdivision report. Ms. Matsumoto: Then there is the matter of the road ownership. Staff: Yes, the applicant definitely needs to talk to Public Works as far as identifying the necessary improvements to Hauaala Road. Ms. Matsumoto: Who owns what. Staff: Exactly. Mr. Kimura: Is it that paved road? Staff: Hauaala Road, right at that Hauaala Road/Kealia Road intersection the road to the west of the intersection is unimproved. Mr. Kimura: Going down towards Keapana? Staff: Correct. The road going towards Anahola is improved. Chair: Any other questions? Mr. Dennis Esaki: Good morning, Dennis Esaki representing the client, the owner. We got this late and looking at the conditions regarding the roadways I would like to ask for a deferral to the next meeting so we can (inaudible) the ownership and the improvement of the roads. Ms. Matsumoto: Move to defer S- 2010 -07, Cornerstone Hawai'i Holdings, LLC, TMK: 4 -7- 002:003, Kealia, Kauai until the next subdivision meeting. Staff: That would be March 23`d. Ms. Matsumoto: Until March 23`d. Mr. Kimura: Second. Chair: Moved and seconded, all those in favor say aye, opposed, thank you. On motion made by Camilla Matsumoto and seconded by Jan Kimura, to defer S- 2010-07 to 3/23/10, motion carried unanimously by voice vote. Subdivision Committee Minutes 2 March 9, 2009 Final Subdivision Action, S- 2003 -25, Michael Lombardi Trust, 9 -lot Subdivision, TMK: 4 -4- 003:155, Kapa`a Homesteads. Kaua'i. Staff: Thank you Mr. Chair. As noted in the subdivision report the proposal involves a 9 -lot subdivision for a parcel in Kapa`a Homesteads. The property is situated along Hauiki Road in the vicinity of the Hauiki Road /Waipouli Road intersection. The final subdivision map has been routed to the various reviewing agencies for final approval. The department has received all of the necessary approval letters. The applicant has met all the requirements of the subdivision and as a result the department is recommending final subdivision approval of this application. Chair: Questions for Dale? Ms. Matsumoto: So this is another sub - standard road that needs to be resolved? Staff: Right so the applicant has made the necessary improvements to the roadway. They made the waterline improvements and at the same time they are dedicating a 20 foot wide roadway lot along the frontage of Hauiki Road. Ms. Matsumoto: And then they are working out the details of the public access? Staff: Yes. Ms. Matsumoto: I have a question about pubic access areas, is there signage for those areas? Not just for this particular project but in general? Staff: I think whenever the County accepts public access points I think by law the County is obligated to provide signage or at least identification markers of these public access points. Ms. Matsumoto: Sometimes I see like a post... Staff: The beach access ones, typically they are identified by a white post and then for trails I believe the County has provided signage, warning signs, signage similar to what you see at the beach whenever you get high surf. Just following up on that, the only public access points that aren't so popular when it comes to providing signage is access to hunting spots or fishing spots. Ms. Matsumoto: I can see why. Chair: (Inaudible). Mr. Kimura: Move to approve final subdivision action for S- 2003 -25, Michael Lombardi Trust, TMK: 4 -4- 003:155, Kapa`a Homesteads, Kaua'i. Ms. Matsumoto: Second. Subdivision Committee Minutes March 9, 2009 Chair: Moved and seconded, all those in favor say aye, opposed, motion carried. On motion made by Jan Kimura and seconded by Camilla Matsumoto, to approve Tmal subdivision for 5- 2003 -25, motion carried unanimously by voice vote. Tentative Subdivision Extension Request, S- 2009 -08, KMN, LLC, 10 -lot Subdivision, TMK: 4 -1- 006:107, Wailua Houselots, Kaua'i. Staff: Thank you Mr. Chair. What you have before you is a 10 -lot subdivision for a property in Wailua Houselots. I just wanted to clarify for the record, I think on the staff report the location is identified as Port Allen, it is in Wailua Houselots. This is the applicant's first extension request and I believe as noted in the staff report the applicant is trying to finalize the infrastructure improvements relating to the subdivision. I have attached a copy of the preliminary subdivision map. The applicant is required to construct a cul -de -sac to serve all of the lots within the subdivision. The applicant's request has been routed to all the reviewing agencies and they have no objections to the extension request. The department is recommending an extension until January 13, 2011. Ms. Matsumoto: I would like to make a motion to approve tentative subdivision extension request for S- 2009 -08, KMN, LLC, TMK: 4 -1- 006:107, Wailua Houselots, Kauai. Mr. Kimura: Second. Chair: Moved and seconded to approve tentative subdivision extension request, all those in favor say aye, opposed, motion carried. On motion made by Camilla Matsumoto and seconded by Jan Kimura, to approve tentative subdivision extension for 5- 2009 -08, motion carried unanimously by voice vote. Modification of Requirements /Condition, S- 2009 -25. County of Kaua'i Kukui'olouo Park Trust Estate, 2 -lot Boundary Adjustment, TMK: 2 -3- 005:002, 006, Kalaheo, Kaua'i. Staff: Thank you Mr. Chair. What you have before you is a request for modification of condition. The applicant is requesting to eliminate two requirements of the tentative approval letter identified as condition's 1(a) and 1(c). As noted in the staff report the proposal redefines the boundaries between two existing lots, one of the lots contains the Water Department's water tank facility that is adjacent to Kukui`olono Park. The intent of the boundary adjustment is to increase the lot size for the water tank site so they can accommodate future improvements to the water tank site. The conditions you see before you, conditions 1(a) and 1(c) are typical requirements for any subdivision. Normally when you have sub - standard roadways fronting a subdivision the department requires a road widening reserve. And then when you have properties within the Agricultural District you will see a broiler plate condition that basically informs the applicant that the permissible uses within that lot should be consistent with Chapter 205 of the State Statutes. Subdivision Committee Minutes 4 March 9, 2009 So in this particular case I think as noted the intent is to accommodate future expansion to the water tank site and as far as the improvements to the water tank site it would not generate any additional traffic on these adjacent roadways. Therefore the department felt that the request to eliminate the conditions was warranted and the department is recommending to eliminate these conditions, 1(a) and 1(c) of the July 29, 2009 tentative approval letter. Chair: Why don't they want these two things? It seems like it would make sense to have that road widening... Staff: I will have the applicant explain to you. Mr. Keith Fujimoto: Good morning Commissioners, I am Keith Fujimoto with the Water Department. I don't really represent the landowner but we are the applicants, we are trying to expand the existing tank site. From what discussions I have had with the landowner their concern of course is any other conditions that are being imposed on their property is going to detract for their property. So they are visibly against it. Chair: Who is the landowner? Mr. Fujimoto: The landowner is McBryde Trust, Bank of Hawai'i are the trustees. Ms. Matsumoto: So they are against eliminating this? Mr. Fujimoto: They are against the conditions for the road widening and the Ag. restriction on the existing properties. Chair: So when you make the road widening reserve it goes through the two parcels, it is not just the Water Department side. tank... Staff: Right. It applies to both affected parcels. Chair: And if further development occurs on the parcel that doesn't include the water Staff: Then we will have opportunity to impose these restrictions again. Mr. Kimura: This is going to come up for us again? Staff: Exactly. Mr. Kimura: And then we can add this condition to that. Staff: Absolutely. Chair: Normally, if it was anybody else besides a public interest you probably wouldn't... Subdivision Committee Minutes March 9, 2009 Staff: We would be against the request. Ms. Kimura: I would like to move to approve the modification of the requirement and condition action on S- 2009 -25, County of Kaua'i Kukui`olono Park Trust Estate, TMK: 2 -3- 005:002, 006, Kalaheo, Kaua'i. Ms. Matsumoto: Second. Chair: Moved and seconded to approve the request, all those in favor say aye, opposed, motion carried.
