HomeMy WebLinkAboutSUB Sept 14 2010KAUAI PLANNING COMMISSION SUBDIVISION COMMITTEE MEETING September 14, 2010 The regular meeting of the Planning Commission Subdivision Committee was called to order by Chair, James Nishida at 8:40 a.m., at the Lihue Civic Center, Mo'ikeha Building, in Meeting Room 2A -213. The following Committee members were present: Mr. James Nishida Ms. Camilla Matsumoto Absent and excused: Mr. Jan Kimura Discussion of the meeting, in effect, ensued: APPROVAL OF THE AGENDA On motion made by Camilla Matsumoto and seconded by James Nishida, to approve the agenda, motion carried unanimously by voice vote. On motion made by Camilla Matsumoto and seconded by James Nishida, to approve Subdivision Committee meeting minutes of August 10, 2010 and August 24, 2010, motion carried unanimously by voice vote. GENERAL BUSINESS MATTERS There were no general business matters. COMMUNICATION There were no communications. UNFINISHED BUSINESS There was no unfinished business. NEW BUSINESS Tentative Subdivision Action, S- 2011 -03, 2 -lot Subdivision, TMK: 2 -4- 004:007, Kalaheo, Kauai, William C. Rita. Staff Planner Dale Cua: Thank you Mr. Chair. What you have before you is a proposed 2 -lot subdivision. I think as noted on the subdivision report the applicant has obtained approval from the Planning Commission to deviate from the pole length requirement of a flag lot. That was approved on January 24, 2006 so what you have before you a follow up to the variance permit which is a 2 -lot subdivision. The application has been routed to the various reviewing agencies for their review and comment. We have received all the agency comments and have been incorporated into the subdivision report. As a result the department is recommending tentative subdivision approval of this application. Chair: Cammie, do you have any questions? Ms. Matsumoto: It has taken a long time. Staff: It has, actually what has happened is the applicant initially applied in 2007 and in working with the requirements of the Department of Water the application expired. So now this is just a re- application of the subdivision and what happened is they reduced the number of lots from 3 to 2. So going to the preliminary subdivision map, Po`ohiwi Road is along the bottom portion of the map. This is Po`ohiwi Road and then the lot so you have two lots being proposed, one is lot 88 -A.1 and the flag lot with the existing residence is lot 88 -A.2. Ms. Matsumoto: So on this map here it would be 88 -A. Staff: It would be 88 -A, so it would be the far left one. Chair: How can you tell it took a long time? Staff: The variance was approved in 2006. Chair: The zoning is R -2, the General Plan is Agriculture and the State Land Use Designation is Rural. Staff: Yes. Chair: So in here it says State Land Use Designation, County General Plan and County Zoning has changed. Staff: Back in 1991 it was designated as Agriculture and amended to Rural Residential but in the update in 2000 which is 9 years later it was amended so the area is Agriculture. Chair: So there was a General Plan change but in 2000 they changed.... Staff: To the General Plan update. Chair: So how does that work with the R -2? Staff: I should follow up. I think it could be Residential Community. Chair: Because it was always that. Subdivision Committee Minutes September 14, 2010 Staff: It was Residential, Rural Residential and now to be consistent the similar General Plan designation with the update is Residential Community. But it would just be applicable to this one lot, not necessarily the lots in the vicinity in the area. Chair: And the Department of Health... Staff: They made a very strong comment regarding the waste water system and basically the Department's position is that in order for the applicant to obtain final approval they have to resolve the requirement directly with the State Health Department. Chair: How come when they say, the waste water branch recommended that this subdivision application be denied, we are not at that point where the application is being approved. This is tentative approval. Staff: This allows the applicant to... it gives the applicant the opportunity to resolve the requirement or the concern with that particular agency. Chair: And it also lists, the tentative approval also lists the other requirements. Staff: Correct. Chair: And then they can start work on the whole thing. Staff: Right. Ms. Matsumoto: Move to approve tentative subdivision action for S- 2011 -03, William C. Rita, TMK 2 -4- 004:007, Kalaheo, Kauai. Chair: Second, all those in favor say aye, opposed, motion carries. On motion made by Camilla Matsumoto and seconded by James Nishida, to approve tentative subdivision action for 5- 2011 -03, motion carried unanimously by voice vote.
