MINUTES of the following meetings of the Council: Executive Meeting of March 31, 2004 COMMUNICATIONS: C 2004-104 Communication (03/Z4/Z004) from the Council Chair, requesting that the Deputy County Engineer be present at the March 31, 2004, Council meeting to provide an update on the status of the Kilauea Gym roof and floor repairs, and to respond to a previous inquiry dated March 5, 2004 from Councihuember Furfaro. (Deferred 03/31/2004) C 2004-110 Communication (03/09/Z004) from the Director of Economic Development, requesting Council approval to apply for, receive, and expend approximately $10,000 in grant funds from the State Department of Business, Economic Development and Tourism's Energy, Resources, and Technology Division, which will be used to pay for methane testing for the Kekaha Landfill, Phase 'Z to determine the methane potential of the landfill, and to defend, indemnify and hold harmless the State. C 2004-1Z5 Communication (0'Z/1'Z/'Z004) from Sally Jo Manea, BSN, Maternal Child Health Coordinator, State Department of Health, requesting time on the Council agenda to brief the Council of a partnership of community agencies, which launched a "Smoke Free Homes -Not in Mama's House" canipaign from March through May, by showing a 1'Z minute video and a description of the local Iaua`i County campaign. C 2004-1Z6 Communication (03/O1/Z004) from the Mayor, transmitting for Council information, the Administration's review and findings of Ordinance No. 795, Relating to Prohibiting Smoking in Designated Areas. C 2004-1Z7 Communication (03/31/Z004) from Councilmember Mel Rapozo, declaring a conflict of interest on ES-1Z0, on the March 31, 2004 agenda, because of the work he completed as an investigator hired by the County of Kauai for the aforementioned case. CZ004-1Z8 Communication (03/15/Z004) from the Ho`olokahi Coordinator, requesting Council approval of a $2,030 grant to the Ia Leo O Iaua`i Committee c/o the YWCA of Iaua`i, for the purchase of materials and the construction of 'ZO picnic tables for Anahola Beach Park. Council Meeting Agenda 3 April 15, 'Z004 C 'Z004-1'Z9 Communication (03/ 18/'Z004) from the Chief of Police, requesting Council approval to apply for, accept, and expend $3,'Z00.00 in grant fiords appropriated by the State of Hawaii, Department of Transportation, to send two ('Z) officers to a course on motorcycle crash investigations, and two ('Z) officers to a course on pedestrian/bicycle crash investigations. C'Z004-130 Communication (03/'Z'Z/'Z004) from the Prosecuting Attorney, requesting Council approval to receive and expend additional federal funds of $67,7'Z 1.00, which will be used for salaries for the Iaua`i VOCA (Iaua`i Victim of Crime Act) Expansion Project, which commenced on October 1, 'Z001 and will expire on September 30, 'Z004. C'Z004-131 Communication (03/'Z'Z/'Z004) from the Prosecuting Attorney, requesting Council approval to receive and expend additional federal funds of $94,988.00, which will be used for salaries for the Iaua`i VOCA (Iaua`i Victim of Crime Act) Expansion Project, which commenced on October 1, 'Z00'Z and will expire on September 30, 'Z004. C'Z004-13'Z Communication (03/'Z6/'Z004) from the Deputy County Engineer, requesting Council approval to apply for, accept, and expend a Federal Highway Fund Grant in the aniount of $3.5 million for the design, construction, and construction management consultation, to complete Phase 'Z curb ramp, curb cuts and sidewalk improvements island wide, that were identified to be non-compliant with the American Disability Act (ADA), by September'Z005. C'Z004-133 Communication (03/'Z9/'Z004) from the Chief, Operations and Construction, Department of Public Works, transmitting for Council infoiluation, his response to the January 1'Z, 'Z004 letter regarding Ialama Bridge located at Pu`u`opae Road in Wailua Homesteads. [Approved.] CR-PPW 2004-4: on Resolution No. 2004-05 A RESOLUTION ESTABLISHING NO- PARIING ZONES, STOP ZONES AND SPEED LIMIT ZONES IN THE PLJHI INDUSTRIAL PARK, LIHU`E DISTRICT [Approved.] RESOLUTIONS: Resolution No. 2004-05, A RESOLUTION ESTABLISHING NO-PARKING ZONES, STOP ZONES AND SPEED LIMIT ZONES IN THE PUHI INDUSTRIAL PARK, LIHU`E DISTRICT (The Parlcs & Public Worlcs Committee recommended approval ori 04/07/2004) Resolution No. 2004-'Z7, RESOLUTION CONFIRMING MAYORAL APPOINTMENT TO THE BUILDING BOARD OF APPEALS (Jose Diogo, First Term) EXECUTIVE SESSION: Pursuant to Haw. Rev. Stat. Council Meeting Agenda 5 April 15, 2004 ES-lZ6 Pursuant to Haw. Rev. Stat. Sections 9'Z-4 and 9Z-5(a)(4), the purpose of this executive session is to consult with the County's legal counsel on questions and issues relating to negotiations with Primatech Construction Company for the repair of Kilauea Gymnasium's roof. This consultation involves consideration of the powers, duties, privileges, immunities, and/or liabilities of the Council and the County as they relate to this agenda item. ADJOURNMENT.
