COMMUNICATIONS:
C 'Z004-'Z70 Communication (09/ 15/'Z004) from Councihuember JoAnn A.
Yukimura, transmitting for Council consideration, a resolution
requesting that the Administration adopt a no-spray policy for a
minimum of two ('Z) county parks, that it give effective notice
and warning for the parks and roadsides where it continues to
spray herbicides and/or pesticides, and that it develop and
implement a no-spray policy for all parks and roadsides by
January 1, 'Z006. (See Resolution No. 2004-45)
C 'Z004-'Z71 Communication (09/03/'Z004) from the Chief, Building
Division, transmitting the Monthly Report on Building Peiluit
Infoiluation for the month of July.
C 'Z004-'Z 7'Z Communication (09/ 14/'Z004) from the Executive Assistant to
the Mayor (Wailua Golf Course), requesting Council approval to
purchase a triplex greens mower, replacing anine-year old unit
for approximately $30,000, with funds available in the
replacement and maintenance account.

C 'Z004-'Z73 Communication (09/ 14/'Z004) from the Director, Office of
Economic Development, requesting Council approval to receive
and expend Workforce Investment Act PY 'Z003 Incentive
Awards for Regional Cooperation and Local Coordination, in
the amount of $5,1'Z'Z.50, which will be used for program
administration or allowable activities under the Youth, Adult,
and/or Dislocated Worker Programs.
C 'Z004-'Z74 Communication (09/ 14/'Z004) from the Executive on Housing,
requesting Council approval to:
1. repurchase Lot 1'Z6, `Ele`ele Nani Subdivision, Phase 'Z
for $'Z 34,550.00,
Z. resell Lot 1'Z6, `Ele`ele Nani Subdivision, Phase 'Z for
$'Z 39,600, and
3. authorize the County Clerk to sign legal documents
related to the repurchase and resale transactions.
C 'Z004-'Z75 Communication (09/0'Z/'Z004) from then Acting Chief of Police,
requesting Council approval to request, receive, and expend
approximately $5,'Z45.00 in Asset Forfeiture Funds, to send
four (4) Iaua`i Police Department self-defense instructors with
Pressure Point Contact Training (PPCT), to an instructor
training course on Oahu, from October 18-'Z'Z, 'Z004 for
recertification training.
C 'Z004-'Z76 Communication (09/ 16/'Z004) from Councihuember Mel
Rapozo, requesting that then Interim Police Chief be present at
the October 7, 'Z004 Council meeting to respond to his inquiry
on the status of the ten (10) Police Department Public Safety
Worker positions that are included in the 'Z004-'Z005 fiscal year
budget.
C'Z004-'Z77 Communication (09/30/'Z004) from the Council Chair,
requesting that the Administrative Assistant be present at the
October 7, 'Z004 Council meeting to provide an update and
status report on the County's contracts for videotaping and
captioning of County meetings.

C'Z004-104 Communication (03/'Z4/'Z004) from the Council Chair,
requesting that the Deputy County Engineer be present at the
March 31, 'Z004, Council meeting to provide an update on the
status of the Kilauea Gym roof and floor repairs, and to
respond to a previous inquiry dated March 5, 'Z004 from
Councihuember Furfaro. (Deferred 09/16/2004)
LEGAL DOCUMENTS:
C 'Z004-'Z78 Communication (08/'Z4/'Z004) from the Mayor, recommending
Council approval of a Quitclaim Dedication Deed from Hawaii
Conference Foundation, conveying to the County of Kauai, a
portion of land (Lot A-'Z), Waimea Town Lots, Waimea, Iaua`i,
for road widening purposes.
CLAIMS:
C 'Z004-'Z79 Communication (09/09/'Z004) from the County Clerk,
transmitting a claim filed against the County of Iaua`i by Kyle
Aguiar, for personal injury damages, pursuant to
Section 'Z3.06, Charter of the County of Kauai.
C 'Z004-'Z80 Communication (09/ 16/'Z004) from the County Clerk,
transmitting a claim filed against the County of Kauai by Darla
Abbatiello, for physical injury, emotional distress and lost
wages, pursuant to Section 'Z 3.06, Charter of the County of
Kauai.
C'Z004-'Z81 Communication (09/'Z'Z/'Z004) from the Cotmty Clerk,
transmitting a claim filed against the County of Kauai by Kyle
Zoe Ann Ii. McCullen, for damage to personal property,
pursuant to Section 'Z 3.06, Charter of the County of Kauai.
RESOLUTIONS:
Resolution No. 2004-45, RESOLUTION REQUESTING THAT THE
ADMINISTRATION ADOPT A NO-SPRAY POLICY FOR MAINTENANCE OF
COUNTY PARKS AND ROADSIDES

EXECUTIVE SESSION: Pursuant to Haw. Rev. Stat. ~"H.R.S.") X92-7(a), the
Council may, when cleemecl necessary, hold an executive session on any
agenda item without written public notice if the executive session was not
anticipated in advance. Any such executive session shall be held pursuant to
H.R.S. X92-4 and shall be limited to those items described in H.R.S. X92-5(a).
(Confidential reports on file in the County Attorney's Office and/or the County
Clerk's Office. Discussions held in Executive Session are closed to the public.)
ES-159 Pursuant to Haw. Rev. Stat. §~92-4 and 92-5(a)(4), the purpose of
this executive session is to discuss the status of County of Kauai
Contract No. 6644 (Island Recycling, Inc.). This consultation
involves consideration of the powers, duties, privileges,
immunities, and/or liabilities of the Council and the County as
they relate to this agenda item. (Deferred 09/30/2004)
